STATE AGENCIES - REAL PROPERTY - Adds to existing law to provide that no
state agency or institution shall purchase, lease or otherwise procure real
property that will be used for office space or building space, which
purchase, lease or procurement will require an appropriation in future
years without an affirmative vote of the Joint Finance-Appropriations
Committee; and to provide a waiver in the event of an emergency or natural

  1                                        AN ACT
  2    RELATING TO STATE BUILDINGS; AMENDING CHAPTER 57, TITLE 67, IDAHO CODE, BY THE
  3        ADDITION OF A NEW SECTION 67-5711D, IDAHO CODE, TO PROVIDE THAT  NO  STATE
  4        AGENCY  OR  INSTITUTION  SHALL  PURCHASE,  LEASE OR OTHERWISE PROCURE REAL
  5        PROPERTY THAT WILL BE USED FOR OFFICE SPACE OR BUILDING SPACE  WHICH  PUR-
  6        CHASE,  LEASE OR PROCUREMENT WILL REQUIRE AN APPROPRIATION IN FUTURE YEARS
  7        WITHOUT AN AFFIRMATIVE VOTE OF THE JOINT FINANCE-APPROPRIATIONS  COMMITTEE
  8        ON  A  MOTION  DULY MADE, ADOPTED  AND RECORDED IN THE COMMITTEE'S MINUTES
  9        AND TO PROVIDE FOR A WAIVER PROVISION IN THE  EVENT  OF  AN  EMERGENCY  OR
 10        DISASTER.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION  1.  That  Chapter  57,  Title 67, Idaho Code, be, and the same is
 13    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 14    ignated as Section 67-5711D, Idaho Code, and to read as follows:
                                                                        
 15        67-5711D.  STATE  AGENCIES PURCHASING, LEASING OR PROCURING REAL PROPERTY.
 16    Notwithstanding any other provision of law to the contrary, no state agency or
 17    institution shall purchase, lease or otherwise procure real property that will
 18    be used for office space or building space which purchase, lease  or  procure-
 19    ment will require an appropriation in future years without an affirmative vote
 20    of  the  joint finance-appropriations committee on a motion duly made, adopted
 21    and recorded in the committee's minutes. In the case of an emergency or disas-
 22    ter, any state agency or institution, through the  department  of  administra-
 23    tion,  may  petition the governor, the president pro tempore of the senate and
 24    the speaker of the house of representatives to have  the  provisions  of  this
 25    section  waived.  The  signature of the governor, president pro tempore of the
 26    senate and the speaker of the house of representatives  shall be all  that  is
 27    necessary for such waiver.

                 STATEMENT OF PURPOSE
                       RS 10146

The purpose of this legislation is to provide direct 
accountability for the decision to obtain office space 
back to elected officials.

                     FISCAL NOTE

Appropriate decision making by elected officials may save 
taxpayer's dollars.
