SENATE CONCURRENT RESOLUTION NO. 146
BY LOCAL GOVERNMENT AND TAXATION COMMITTEE
1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE IDAHO
3 STATE TAX COMMISSION RELATING TO TRADE-INS, TRADE-DOWNS AND BARTER.
4 Be It Resolved by the Legislature of the State of Idaho:
5 WHEREAS, the Legislature is vested with authority to reject executive
6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
7 that the Legislature finds that the rules are not consistent with legislative
8 intent; and
9 WHEREAS, it is the finding of the Legislature that certain rules of the
10 Idaho State Tax Commission relating to trade-ins, trade-downs and barter are
11 not consistent with legislative intent and should be rejected.
12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
13 sion of the Fifty-fifth Idaho Legislature, the Senate and the House of Repre-
14 sentatives concurring therein, that IDAPA 35.01.02, Section 044, rules of the
15 Idaho State Tax Commission relating to trade-ins, trade-downs and barter,
16 adopted as a pending rule under Docket number 35-0102-9902, be, and the same
17 is hereby rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE
RS09991
This concurrent resolution would reject a pending rule of the Idaho State Tax
commission relating to trade-ins, trade-downs and barter. The effects of this
resolution, if adopted by both houses, would be to prevent the agency rule from
going into effect.
FISCAL NOTE
This resolution has no fiscal impact.
