  1                                        AN ACT
  2    RELATING TO THE COMMISSION ON AGING; AMENDING  CHAPTER  50,  TITLE  67,  IDAHO
  3        CODE,  BY  THE ADDITION OF A NEW SECTION 67-5012, IDAHO CODE, TO CREATE AN
  4        ADULT PROTECTION SERVICES EMERGENCY FUND.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Chapter 50, Title 67, Idaho Code, be,  and  the  same  is
  7    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  8    ignated as Section 67-5012, Idaho Code, and to read as follows:
                                                                        
  9        67-5012.  ADULT PROTECTION SERVICES EMERGENCY FUND. (1)  There  is  hereby
 10    created in the state treasury a fund to be known as the "adult protection ser-
 11    vices  emergency fund" to which shall be deposited such funds as may be appro-
 12    priated to it or as otherwise provided by law, or as may be provided  by  pri-
 13    vate sources. Interest earned on idle moneys in the fund shall be paid to such
 14    fund.  Any  unencumbered,  unexpended funds remaining at the end of the fiscal
 15    year may be retained in the fund for use in the following fiscal year.
 16        (2)  Moneys in the fund shall be used exclusively for the  following  pur-
 17    poses:
 18        (a)  The  temporary financing of emergency placement and other life neces-
 19        sities, with consent, for at-risk vulnerable adults in community-based  or
 20        facility environments; or
 21        (b)  The  financing  of transportation for at-risk vulnerable adults, with
 22        consent, to access formal or informal supports.
 23        (3)  The administrator of the commission on aging shall have the authority
 24    and the responsibility to administer moneys for the purposes indicated.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                           RS 10501

The proposed legislation will create an emergency fund related to
the provision of Adult Protection services. The fund will be used
to effectuate placement of vulnerable adults, with consent, in
community based and facility environments to ensure their health
and safety. The fund will be used for placement of vulnerable
adults only under emergency circumstances.


                              FISCAL IMPACT


An appropriation of $25,000 will be requested during the 2001
legislative session to finance the Adult Protection emergency fund. 
The fund will be designed to allow carryover unexpended funding
between fiscal years and allow private contributions into the fund.
