  1                                        AN ACT
  2    RELATING TO SITING OF MANUFACTURED HOMES IN RESIDENTIAL AREAS;  AMENDING  SEC-
  3        TION  67-6509A,  IDAHO  CODE,  TO PROVIDE A MANUFACTURED HOME SHALL HAVE A
  4        GARAGE OR CARPORT CONSTRUCTED OF LIKE MATERIALS IF ZONING ORDINANCES WOULD
  5        REQUIRE A NEWLY CONSTRUCTED NONMANUFACTURED HOME TO HAVE A GARAGE OR  CAR-
  6        PORT; AND DECLARING AN EMERGENCY.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That Section 67-6509A, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        67-6509A.  SITING OF MANUFACTURED HOMES IN RESIDENTIAL AREAS -- PLAN TO BE
 11    AMENDED. (1) By resolution or ordinance adopted, amended or repealed in accor-
 12    dance with the notice and hearing procedures provided under  section  67-6509,
 13    Idaho  Code,  each governing board shall amend its comprehensive plan and land
 14    use regulations for all land zoned for single-family residential uses,  except
 15    for  lands falling within an area defined as a historic district under section
 16    67-4607, Idaho Code, to allow for siting of manufactured homes as  defined  in
 17    section 39-4105(13), Idaho Code.
 18        (2)  Manufactured  homes  on individual lots zoned for single-family resi-
 19    dential uses as provided in subsection (1) of this section shall be  in  addi-
 20    tion to manufactured homes on lots within designated mobile home parks or man-
 21    ufactured home subdivisions.
 22        (3)  This section shall not be construed as abrogating a recorded restric-
 23    tive covenant.
 24        (4)  A  governing  board  may  adopt any or all of the following placement
 25    standards, or any less restrictive standards, for the approval of manufactured
 26    homes located outside mobile home parks:
 27        (a)  The manufactured home shall be multisectional and enclose a space  of
 28        not less than one thousand (1,000) square feet;
 29        (b)  The  manufactured home shall be placed on an excavated and backfilled
 30        foundation and enclosed at the perimeter such that the home is located not
 31        more than twelve (12) inches above grade;
 32        (c)  The manufactured home shall have a pitched roof, except that no stan-
 33        dards shall require a slope of greater than a nominal three  (3)  feet  in
 34        height for each twelve (12) feet in width;
 35        (d)  The manufactured home shall have exterior siding and roofing which in
 36        color,  material  and  appearance  is  similar  to the exterior siding and
 37        roofing material commonly used on residential dwellings within the  commu-
 38        nity or which is comparable to the predominant materials used on surround-
 39        ing dwellings as determined by the local permit approval authority;
 40        (e)  The  manufactured  home shall have a garage or carport constructed of
 41        like materials. A governing board may require an attached or detached gar-
 42        age in lieu of a carport where such is  consistent  with  the  predominant
 43        construction  of  immediately  surrounding  dwellings if zoning ordinances

  1        would require a newly constructed nonmanufactured home to have a garage or
  2        carport;
  3        (f)  In addition to the provisions of paragraphs (a) through (e)  of  this
  4        subsection,  a  city or county may subject a manufactured home and the lot
  5        upon which it is sited to any development standard, architectural require-
  6        ment and minimum size requirements to which a  conventional  single-family
  7        residential dwelling on the same lot would be subjected.
  8        (5)  Any  approval  standards,  special  conditions and the procedures for
  9    approval adopted by a local government shall be clear and objective and  shall
 10    not  have  the  effect,  either in themselves or cumulatively, of discouraging
 11    needed housing through unreasonable cost or delay.
                                                                        
 12        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 13    declared to exist, this act shall be in full force and effect on and after its
 14    passage and approval.

The purpose of this legislation is to ensure that if zoning ordinances
require a manufactured home to have a garage or carport, the same
requirement will apply to a non-manufactured home.
