  1                                        AN ACT
  2    RELATING TO THE ELECTION OF  COMMISSIONERS  OF  A  FIRE  PROTECTION  DISTRICT;
  3        AMENDING  SECTION  31-1408A, IDAHO CODE, TO GOVERN THE ELECTION OF COMMIS-
  4        SIONERS FROM EXPANDED BOARDS OF FIRE  PROTECTION  DISTRICTS  AND  TO  MAKE
  5        TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
                                                                        
  7        SECTION  1.  That Section 31-1408A, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        31-1408A.  DECISION TO INCREASE THE SIZE OF THE BOARD. Subsequent  to  the
 10    creation  of a fire protection district and the appointment of the first board
 11    of fire protection commissioners, the fire protection board may, by a majority
 12    vote of all of the fire protection district board members  elect  to  increase
 13    the size of the board to five (5) members.
 14        If the board of fire protection commissioners elect to expand the board to
 15    five (5) members, the existing board members shall subdivide the district into
 16    five (5) subdivisions as nearly equal in population, area and mileage as prac-
 17    ticable to be known as subdistricts one, two, three, four and five.
 18        At  the first election following the decision of the board of fire protec-
 19    tion commissioners to expand the board from three (3)  to  five  (5)  members,
 20    five  (5) commissioners shall be elected. The cCommissioners from fire protec-
 21    tion subdistricts one, shall be elected for a term of one (1) year;  the  com-
 22    missioner  from  subdistrict two for two (2) years; the commissioner from sub-
 23    district three for three (3) years; and the  commissioners  from  subdistricts
 24    four  and  five  shall be elected for terms of four (4) years. and the commis-
 25    sioners from subdistricts two (2) and four (4) shall be elected for a term  of
 26    two  (2)  years.  Thereafter,  the term of all commissioners shall be four (4)
 27    years.
 28        A fire district which, prior to the effective date of  this  section,  had
 29    elected  to  expand a board from three (3) to five (5) members shall, prior to
 30    the next election of the district,  adopt  a  transition  schedule  as  nearly
 31    reflecting  the  schedule provided in this section as possible so that one (1)
 32    commissioner is elected each year except that in one (1) year, two (2) commis-
 33    sioners are elected.

    The purpose of this legislation is to govern the election of
commissioners from expanded boards of fire protection districts.

                          FISCAL IMPACT
                                

     There is no fiscal impact to the general fund.  There will be
a negligible or non-existent fiscal impact to the local entity
involved.
