presidential electors shall cast their ballots for the persons who received
the highest number of votes for president and vice president of the United
States, respectively, in the most recently conducted general election in

  1                                        AN ACT
  2    RELATING TO PRESIDENTIAL ELECTORS; AMENDING SECTION 34-1503,  IDAHO  CODE,  TO
  3        PROVIDE  THAT  PRESIDENTIAL ELECTORS SHALL CAST THEIR BALLOTS FOR THE PER-
  4        SONS WHO RECEIVED THE HIGHEST NUMBER OF VOTES FOR PRESIDENT AND VICE PRES-
  5        IDENT OF THE UNITED STATES, RESPECTIVELY, IN THE MOST  RECENTLY  CONDUCTED
  6        GENERAL ELECTION IN THE STATE OF IDAHO AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 34-1503, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        34-1503.  MEETING OF ELECTORS. The electors chosen to  elect  a  president
 11    and  vice-president  vice president of the United States shall, at twelve (12)
 12    o'clock noon on the day which is or may be directed by  the  Congress  of  the
 13    United  States,  meet  at  the  seat of government of this state, and then and
 14    there perform the duties enjoined upon them by the Constitution  and  laws  of
 15    the United States.
 16        The  electors  shall  cast  their ballots for the persons who received the
 17    highest number of votes for president and vice president of the United States,
 18    respectively, in the most recently conducted general election in the state  of
 19    Idaho.

Statement of Purpose / Fiscal Impact



	              STATEMENT OF PURPOSE
                            RS11140

The purpose of this legislation is to mandate that the electors 
chosen to elect a President and Vice-President shall cast their 
ballots for the persons who received the highest number of votes 
for President and Vice-President of the United States.  Currently 
the State of Idaho does not legally require the electors cast 
their ballots based on which candidates received the highest 
number of votes.

	           FISCAL IMPACT

No fiscal impact is expected as a result of this legislation.
