  1                                        AN ACT
  2    RELATING TO THE LEGISLATIVE ACCOUNT; AMENDING SECTION 67-451, IDAHO  CODE,  TO
  3        INCREASE  THE AMOUNT OF MONEYS TRANSFERRED TO THE LEGISLATIVE ACCOUNT FROM
  4        THE GENERAL FUND  BY THE STATE CONTROLLER COMMENCING JUNE 1, 2001  AND  TO
  5        MAKE A TECHNICAL CORRECTION; APPROPRIATING MONEYS FROM THE GENERAL FUND TO
  6        THE LEGISLATIVE ACCOUNT; AND DECLARING AN EMERGENCY.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section  67-451, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        67-451.  LEGISLATIVE ACCOUNT CREATED -- DUTIES OF CONTROLLER --  DISBURSE-
 11    MENTS  FROM ACCOUNT -- REPORT OF DISBURSEMENTS. (1) There is hereby created in
 12    the state treasury the legislative account. The legislative account shall con-
 13    sist of such moneys as are placed into it by other appropriations, by receipts
 14    paid into the legislative account, and the moneys appropriated and transferred
 15    into it according to the provisions of this act.
 16        (2)  There is hereby appropriated out of the general fund and  transferred
 17    into  the legislative account, and commencing July June 1, 19932001, the state
 18    controller is authorized and directed to make such transfers  in  the  amounts
 19    shown on each of the following dates in each year:
 20             January 1                                                $1,17520,000

 24        (3)  The  president pro tempore of the senate and the speaker of the house
 25    of representatives are hereby authorized to make expenditures out of the  leg-
 26    islative  account for any necessary expenses of the legislature and the legis-
 27    lative account is hereby perpetually appropriated for any  necessary  expenses
 28    of  the  legislature. Necessary expenses of the legislature shall include, but
 29    are not necessarily limited to, salaries and wages of officers,  members,  and
 30    employees  of  the  legislature,  consultants and other expert or professional
 31    personnel, travel expenses of officers, members, and employees of the legisla-
 32    ture, other current expenses incurred in any operation or function of the leg-
 33    islature, premiums for life, accidental  death  and  dismemberment,  hospital,
 34    medical,  surgical  and major medical insurance for members of the legislature
 35    during their terms of office, and for employees of the legislature during  the
 36    period  of their employment, and capital outlay items necessary for any opera-
 37    tion or function of the legislature. The signature of the president  pro  tem-
 38    pore  of  the  senate  or  the  speaker of the house of representatives on any
 39    voucher or claim for payment shall be sufficient authority for the state  con-
 40    troller  to pay the same. Expenses for any interim activity of the legislature
 41    or legislators shall be paid in the same manner. Expenses for any interim leg-
 42    islative committees shall be paid in the same manner, if previously authorized
 43    by concurrent resolution.

  1        (4)  The state controller is hereby directed to  devise  and  implement  a
  2    financial  reporting  and  control  system  for  the purposes of this act that
  3    exempts legislative expenditures from any other provision of law, and the leg-
  4    islative account shall be specifically exempt from the provisions  of  chapter
  5    35, title 67, Idaho Code, and shall be specifically exempt from the provisions
  6    of  chapter  36, title 67, Idaho Code. Such system must produce a report as of
  7    the end of each calendar month that clearly shows additions  to  the  account,
  8    the  unexpended    balance  in  the account, the expenditures to date, and the
  9    expenditures for the month reported, suitably detailed in such manner  as  the
 10    presiding  officers  may  instruct the state controller. A copy of such report
 11    must be delivered to the president pro tempore of the senate and  the  speaker
 12    of the house of representatives and to the governor by no later than the fifth
 13    working day of the following month.
                                                                        
 14        SECTION 2.  There is hereby appropriated the sum of $345,000 from the Gen-
 15    eral Fund to the Legislative Account.
                                                                        
 16        SECTION  3.  An  emergency  existing  therefor,  which emergency is hereby
 17    declared to exist, this act shall be in full force and effect on and after its
 18    passage and approval.

Statement of Purpose / Fiscal Impact


                 	STATEMENT OF PURPOSE

                            RS 11266

This bill increases the amount appropriated and transferred from 
the General Fund to the Senate and House legislative accounts in 
accordance with Section 67-451, Idaho Code. These transfers occur 
each January 1, March 1, June 1, and September 1. Currently, the 
total amount appropriated each year is $4,350,000, split 60:40 
between the House and Senate. These proposed changes to Section 
67-451 become effective on June 1, 2001. Section 2 of this 
legislation transfers $345,000 immediately upon passage of the bill
to deal with projected cash flow needs in FY 2002.

The last statutory change to the funding level for the Legislature 
was in July 1993, which was a reduction of $300,000 rather than an 
increase. The amount was last increased to $4,650,000 on March 1, 
1991, and before that to $3,250,000 on June 1, 1989.



                        FISCAL IMPACT


The impact to the General Fund is $595,000 in FY 2001, and 
$1,250,000 in future years. The total amount of the legislative 
transfer will be $5,600,000 each year.
