  1                                        AN ACT
  2    RELATING TO TAX RELIEF; AMENDING TITLE 57, IDAHO CODE, BY THE  ADDITION  OF  A
  3        NEW  CHAPTER  20, TITLE 57, IDAHO CODE, TO PROVIDE FOR THE CREATION OF THE
  4        TAX RELIEF FUND, TO SPECIFY THE PURPOSE OF THE FUND  AND  TO  PROVIDE  FOR
  5        ALLOCATION OF CERTAIN MONEYS TO THE FUND.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That Title 57, Idaho Code, be, and the same is hereby amended
  8    by the addition thereto of a NEW CHAPTER, to be known and designated as  Chap-
  9    ter 20, Title 57, Idaho Code, and to read as follows:
                                                                        
 10                                      CHAPTER 20
 11                                   TAX RELIEF FUND
                                                                        
 12        57-2001.  TAX  RELIEF FUND CREATED -- PURPOSE. There is hereby created and
 13    established in the state treasury a fund to be known as the "Tax Relief  Fund"
 14    to  which  shall  be  credited  or  deposited  all moneys specified in section
 15    57-2002, Idaho Code. Moneys in the fund may be transferred by the  legislature
 16    to the general fund to offset the fiscal impact to the general fund of any tax
 17    reduction measure or measures.
                                                                        
 18        57-2002.  MONEYS  ALLOCATED  TO  THE  TAX RELIEF FUND. Notwithstanding any
 19    other provision of law, for fiscal year 2002 and all fiscal years  thereafter,
 20    if  the  state  controller certifies that the receipts to the general fund for
 21    the fiscal year just ending have exceeded the receipts of the previous  fiscal
 22    year  by  more than six percent (6%), then the state controller shall transfer
 23    all general fund collections in excess of such six percent  (6%)  increase  to
 24    the tax relief fund, to be used for the purposes set forth in section 57-2001,
 25    Idaho Code.

This legislation would create a cap on the amount of general fund 
revenue increases that can be spent on agency budget increases at 6% 
and to create a fund for all the revenue in excess of 6% dedicated to 
tax relief.

	                 FISCAL IMPACT
This legislation will affect agency budgets to the extent such budgets 
exceed 6% growth for any given year.
