  1                                        AN ACT
  2    RELATING TO RULES OF THE ROAD; AMENDING CHAPTER 6, TITLE 49,  IDAHO  CODE,  BY
  3        THE  ADDITION  OF A NEW SECTION 49-658, IDAHO CODE, TO PROVIDE FOR REDUCED
  4        SPEED LIMITS IN SCHOOL ZONES, TO SPECIFY A FIXED PENALTY FOR EXCEEDING THE
  5        POSTED SPEED LIMIT IN A SCHOOL ZONE AND TO PROVIDE FOR  REDUCTION  OF  THE
  6        MAXIMUM  PENALTY  BY ORDINANCE OF THE APPROPRIATE CITY COUNCIL OR BOARD OF
  7        COUNTY COMMISSIONERS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Chapter 6, Title 49, Idaho Code,  be,  and  the  same  is
 10    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 11    ignated as Section 49-658, Idaho Code, and to read as follows:
                                                                        
 12        49-658.  SCHOOL SPEED ZONE PENALTIES. (1)  No person shall operate a vehi-
 13    cle in excess of the posted maximum speed limit established for a school  zone
 14    when  the  school zone is designated by appropriately placed signs indicating:
 15    the school zone; the reduced speed limit  for  the  zone;  and  notice  of  an
 16    enhanced penalty for exceeding the reduced speed limit.
 17        (2)  Violation  of  the  provisions of this section shall be an infraction
 18    punishable by a fixed penalty of forty-one dollars ($41.00) if  the  violation
 19    is more than one (1) but less than twenty (20) miles per hour above the posted
 20    school zone speed limit, and punishable by a fixed penalty of one hundred dol-
 21    lars ($100) if the violation is more than twenty (20) miles per hour above the
 22    posted school zone speed limit.
 23        (3)  Nothing shall prevent a city council or a board of county commission-
 24    ers from adopting an ordinance which reduces the maximum fixed penalty imposed
 25    by  the provisions of subsection (2) of this section, provided the school with
 26    the reduced speed zone is situated within the  jurisdiction  of  the  city  or
 27    county.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

    The purpose of the school safety bill is to protect children
    by reducing speeding in school zones. One of the most effective
    ways to do this is by increasing the fine for speeding in a
    school zone. Local authorities determine the boundaries and speed
    limits for school zones, but the fine for an infraction is set in
    state code. Under this bill, the fines for speeding in school
    zones would be $41 for speeding less than 20 MPH over the speed
    limit and $100 if 20 MPH or more over the limit. The bill also
    permits cities and counties to implement the higher fines within
    their jurisdiction.
    
                          FISCAL IMPACT
                                
    The school safety bill creates some expense to the local
    road authority responsible for installing the "enhanced penalty"
    signs, ranging in cost from $25 to $40 each.
    The bill raises revenue through the additional penalty added
    to the speeding tickets. For example, the enhanced penalty for
    speeding in construction zones brought in an additional $26,933
