IRRIGATION DISTRICTS - Amends existing law to require that an order of the
board of directors of an irrigation district changing the boundaries of an
irrigation district shall be filed in the recorder's office of the county
within which the annexed lands are situated; and to require that an
exclusion order of an irrigation district shall be filed in the recorder's

  1                                        AN ACT
  2    RELATING TO ANNEXATION AND EXCLUSION OF  IRRIGATION DISTRICT  LANDS;  AMENDING
  3        SECTION  43-1010,  IDAHO  CODE,  TO  REQUIRE THAT AN ORDER OF THE BOARD OF
  4        DIRECTORS OF AN IRRIGATION DISTRICT CHANGING THE BOUNDARIES OF AN  IRRIGA-
  5        TION DISTRICT SHALL BE FILED IN THE RECORDER'S OFFICE OF THE COUNTY WITHIN
  6        WHICH  THE ANNEXED LANDS ARE SITUATED; AND AMENDING SECTION 43-1108, IDAHO
  7        CODE, TO REQUIRE THAT AN EXCLUSION ORDER SHALL BE FILED IN THE  RECORDER'S
  8        OFFICE OF THE COUNTY WITHIN WHICH ARE SITUATED THE EXCLUDED LANDS.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 43-1010, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        43-1010.  ORDER TO BE RECORDED. Upon a change of the boundaries of a  dis-
 13    trict becoming effective, a copy of the order of the board of directors order-
 14    ing  such change, certified by the president and secretary of the board, shall
 15    be filed for record in the recorder's office of each the county  within  which
 16    the  annexed  lands are situated, any of the lands of the district, and there-
 17    upon the district shall be and remain an irrigation district, as fully and  to
 18    every  intent  and purpose, as if the lands which are included in the district
 19    by the change of the boundaries as aforesaid, had been included therein at the
 20    original organization of the district.
                                                                        
 21        SECTION 2.  That Section 43-1108, Idaho Code, be, and the same  is  hereby
 22    amended to read as follows:
                                                                        
 23        43-1108.  CHANGES  TO  BE  FILED FOR RECORD. The decision and order of the
 24    board of directors or the district court, in case  of  appeal,  excluding  the
 25    petitioner's  land  and  changing  the  boundaries of such irrigation district
 26    shall be filed for record in the recorder's office of the county  or  counties
 27    within which are situated the excluded lands. of such irrigation district.
