INSURANCE - Amends existing law to provide that if an insurance policy
provides benefits for pregnancy, childbirth or miscarriage, and an employee
or dependent is pregnant at the time of discontinuance of the policy and
not eligible for any replacement group coverage within sixty days of
discontinuance, the policy must provide that the benefits will be payable
to the same extent as if discontinuance had not occurred, but not beyond a

                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                                        AN ACT
  2    RELATING TO MATERNITY BENEFITS; AMENDING SECTION 41-2214, IDAHO CODE, TO  PRO-
  3        VIDE  THAT  IF AN INSURANCE POLICY PROVIDES BENEFITS FOR PREGNANCY, CHILD-
  4        BIRTH OR MISCARRIAGE AND AN EMPLOYEE OR DEPENDENT IS PREGNANT AT THE  TIME
  5        OF  DISCONTINUANCE  OF  THE POLICY AND IS NOT ELIGIBLE FOR ANY REPLACEMENT
  6        GROUP COVERAGE WITHIN SIXTY DAYS OF DISCONTINUANCE, THE POLICY  MUST  PRO-
  7        VIDE  THAT  THE  BENEFITS WILL BE PAYABLE TO THE SAME EXTENT AS IF DISCON-
  8        TINUANCE HAD NOT OCCURRED BUT NOT BEYOND A PERIOD OF TWELVE MONTHS FOLLOW-
  9        ING DISCONTINUANCE AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION 1.  That Section 41-2214, Idaho Code, be, and the same  is  hereby
 12    amended to read as follows:
                                                                        
 13        41-2214.  POLICY STANDARDS -- MATERNITY BENEFITS. If a policy provides any
 14    benefits  for  pregnancy,  childbirth  or  miscarriage  and  if an employee or
 15    dependent covered for such benefit is pregnant at the time  of  discontinuance
 16    and  is not eligible for any replacement group coverage within sixty (60) days
 17    of discontinuance, the policy must provide that benefits will  be  payable  to
 18    the same extent as if discontinuance had not occurred for any covered benefits
 19    in  connnection connection with such pregnancy, childbirth or miscarriage, but
 20    not beyond a period of twelve (12) months following such discontinuance.

This legislation amends an existing section of the insurance code to reflect a prior administrative interpretation that has been the industry practice for nineteen years.
