  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE IDAHO STATE HISTORICAL SOCIETY  FOR  FISCAL  YEAR
  3        2002;  LIMITING THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIA-
  4        TING ANY UNEXPENDED AND UNENCUMBERED GENERAL FUND  BALANCES;  AND  SETTING
  5        FORTH CONDITIONS FOR THE REAPPROPRIATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  There  is hereby appropriated to the State Board of Education
  8    for the Idaho State Historical Society the following amounts, to  be  expended
  9    for  the  designated programs according to the designated expense classes from
 10    the listed funds for the period July 1, 2001, through June 30, 2002:

 33        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the agency  is
 34    authorized  no more than fifty-one and thirty-six hundredths (51.36) full-time
 35    equivalent positions at any point during the period July 1, 2001, through June
 36    30, 2002, for the programs specified in Section 1 of this act, unless specifi-
 37    cally authorized by the Governor. The Joint  Finance-Appropriations  Committee
 38    will be notified promptly of any increased positions so authorized.
                                                                        
 39        SECTION 3.  There is hereby reappropriated to the State Board of Education
 40    for the Idaho State Historical Society the unexpended and unencumbered balance
 41    of any General Fund appropriation contained in Section 1, Chapter 434, Laws of

  1    2000,  to  be  used for nonrecurring expenditures for the period July 1, 2001,
  2    through June 30, 2002.
                                                                        
  3        SECTION 4.  The reappropriation granted in Section 3 of this act shall  be
  4    subject to the following provisions:
  5        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
  6    June 30, 2001, is zero, the reappropriation in Section 3 of this act is hereby
  7    declared to be null and void.
  8        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
  9    June  30,  2001, is greater than zero but less than the total General Fund re-
 10    appropriation authority granted to all state agencies, the amount  reappropri-
 11    ated in Section 3 of this act shall be in the proportion that the reappropria-
 12    tion  for  the  Idaho State Historical Society bears to the total General Fund
 13    reappropriation authority granted to all state agencies.
