  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING AND DIRECTING THE LEGISLA-
  3        TIVE COUNCIL TO APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A  STUDY  OF
  4        APPROPRIATE AND EFFECTIVE MEANS OF FUNDING PUBLIC SCHOOL FACILITIES.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS,  the  Idaho  Legislature  recognizes the importance of the public
  7    school system and the responsibility placed upon the Legislature by  the  Con-
  8    stitution  of the State of Idaho that the children of this state shall be edu-
  9    cated in a system which is general, uniform and thorough; and
 10        WHEREAS, a challenge to the current funding of school facilities has  been
 11    and  is  being  litigated  in the courts of the state of Idaho, and while that
 12    case is still pending, clearly, the Legislature recognizes that it  is  incum-
 13    bent  upon  the  Legislature  to  seek a timely and meaningful response to the
 14    issues presented; and
 15        WHEREAS, the court in its findings has recognized that the Legislature has
 16    before it many options to address facility  needs  and  that  there  are  many
 17    issues  to  be  considered to assure that the solution is comprehensive, effi-
 18    cient and fair and the court has invited and urged the Legislature to  address
 19    and resolve the school facilities issue; and
 20        WHEREAS, other states have addressed this problem with programs which dis-
 21    tribute  state  appropriated  funds based upon a priority of projects, provide
 22    matching grants with a ratio which varies based upon the wealth  of  the  dis-
 23    trict,  provide  funds to match bond proceeds, or lower the supermajority vote
 24    requirement for bond passage and that these and many other possible  solutions
 25    are  available and must be reviewed, studied and evaluated as to potential for
 26    use in the state of Idaho; and
 27        WHEREAS, it is evident and beyond question that the Legislature must  find
 28    a  way  to  address  the  need  for funding safe school buildings and that the
 29    appropriate remedy will best emerge from the legislative process; and
 30        WHEREAS, it is expedient that the Legislature act,  through  this  resolu-
 31    tion, to establish a committee to consider the broad range of alternatives and
 32    provide recommendations and guidance to the Legislature to reach genuine solu-
 33    tions to the problems identified.
 34        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 35    of  the Fifty-sixth Idaho Legislature, the Senate and the House of Representa-
 36    tives concurring therein, that  the  Legislative  Council  is  authorized  and
 37    directed to appoint a committee to undertake and complete a study of appropri-
 38    ate  and  effective means of funding public school facilities. The Legislative
 39    Council shall determine the number of legislators  and  membership  from  each
 40    house  appointed to the committee and shall authorize the committee to receive
 41    input, advice and assistance from interested and affected parties who are  not
 42    members of the Legislature.
 43        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
 44    ommendations and proposed legislation, if any, to the Second  Regular  Session
