1 AN ACT
2 RELATING TO THE COMPREHENSIVE STATE WATER PLAN; RATIFYING AND APPROVING THE
3 COMPREHENSIVE STATE WATER PLAN FOR THE LITTLE SALMON RIVER BASIN AS
4 ADOPTED BY THE IDAHO WATER RESOURCE BOARD ON OCTOBER 19, 2001; AND DECLAR-
5 ING AN EMERGENCY.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That pursuant to Section 42-1734B(6), Idaho Code, the Compre-
8 hensive State Water Plan for the Little Salmon River Basin, adopted by resolu-
9 tion of the Idaho Water Resource Board on October 19, 2001, be, and the same
10 is hereby ratified and approved. In accordance with Section 42-1734A, Idaho
11 Code, the basin plan includes the protected river reach designations summa-
12 rized as follows:
13 (1) Little Salmon River, Highway 95 bridge at river mile 24.7 (above "The
14 Falls") to its confluence with the Salmon River (24.7 miles) - Recre-
15 ational.
16 (2) Boulder Creek, headwaters to its confluence with the Little Salmon
17 River (18.6 miles) - Recreational.
18 (3) Hard Creek, headwaters to its confluence with Hazard Creek (12.0
19 miles) - Recreational.
20 (4) Hazard Creek, Hazard Lake outlet to its confluence with the Little
21 Salmon River (12.5 miles) - Recreational.
22 The following activities are prohibited within these reaches:
23 -Construction or expansion of dams or impoundments,
24 -Dredge or placer mining (including recreational dredge mining),
25 and
26 -Mineral or sand and gravel extraction within the stream chan-
27 nel.
28 -Other alterations of the stream channel are prohibited, except
29 as provided below.
30 The following activities are allowed if they do not impede fish and
31 boat passage:
32 -Construction of water diversion works for domestic, commercial,
33 municipal, industrial, agricultural, and hydropower uses;
34 and
35 -Alterations of the stream channel for protection and mainte-
36 nance of private property, for flood control, for public
37 recreation facilities, and for fish and wildlife enhance-
38 ment structures.
39 SECTION 2. An emergency existing therefor, which emergency is hereby
40 declared to exist, this act shall be in full force and effect on and after its
41 passage and approval.
STATEMENT OF PURPOSE
RS 11793
Passage of this proposed legislation will give final approval to
the Little Salmon River Basin component of the comprehensive State
Water Plan. The Little Salmon River Basin Plan examines the water
and related resources within the basin, and contains water management
recommendations and actions to protect waterways and to pursue
minimum stream flows. The Plan protects 68 miles as state
Recreational Rivers, and commits the Board to apply for minimum
stream flows in the lower Rapid River and the Little Salmon River.
FISCAL IMPACT
Fiscal impact is anticipated to be positive over the long term. State
protected river designations provide a safeguard for river reaches
with outstanding scenic, recreational and fish and wildlife values.
Designations cannot interfere with vested property rights, and are
conditioned, where appropriate, to provide for development and
continued utilization of the basin’s natural resources.
