2 RELATING TO LICENSURE AND REGULATION OF FOOD ESTABLISHMENTS; AMENDING SECTIONS
3 11 AND 12, CHAPTER 194, LAWS OF 1997, AS AMENDED BY SECTIONS 1 AND 2,
4 CHAPTER 176, LAWS OF 2000, TO MOVE THE SUNSET CLAUSE AHEAD FIVE YEARS.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 11, Chapter 194, Laws of 1997, as amended by Sec-
7 tion 1, Chapter 176, Laws of 2000, be, and the same is hereby amended to read
8 as follows:
9 SECTION 11. Section 7 of this act shall be null, void and of no force and
10 effect on and after July 1, 20027.
11 SECTION 2. That Section 12, Chapter 194, Laws of 1997, as amended by Sec-
12 tion 2, Chapter 176, Laws of 2000, be, and the same is hereby amended to read
13 as follows:
14 SECTION 12. Sections 9 and 10 of this act shall be in full force and
15 effect on and after July 1, 20027.

HOUSE AMENDMENT TO H.B. NO. 640
1 AMENDMENT TO THE BILL
2 On page 1 of the printed bill, following line 15, insert:
3 "SECTION 3. That Section 39-1607, Idaho Code, be, and the same is hereby
4 amended to read as follows:
5 39-1607. LICENSE FEE. A fee may be charged by the department of health
6 and welfare for licensing a food establishment. The fee shall not exceed
7 fiftysixty-five dollars ($565.00) per establishment per year. Fees collected
8 for licensing a food establishment shall be deposited in the food safety fund
9 and shall be used for funding a portion of the food safety inspection program.
10 ".
11 CORRECTION TO TITLE
12 On page 1, in line 4, following "YEARS" insert: "AND AMENDING SECTION
13 39-1607, IDAHO CODE, TO INCREASE THE MAXIMUM FEE THAT MAY BE CHARGED FOR
14 LICENSING A FOOD ESTABLISHMENT BY THE DEPARTMENT OF HEALTH AND WELFARE".

STATEMENT OF PURPOSE
RS 12001
This bill raises the license fee from $55.00 to $65.00. It
extends the sunset for the license requirements for food
establishments and also extends the sunset on the licensing
fee that is paid by these establishments to July 1, 2007.
FISCAL IMPACT
There is no fiscal impact to the general fund. Local health
districts will receive approximately an additional $12,440 to
carry out the inspections.
