|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature Second Regular Session - 2002IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 465 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO HAZING; AMENDING SECTION 18-917, IDAHO CODE, TO PROHIBIT STUDENTS 3 ON OR NEAR SCHOOLS FROM HAZING ANY MEMBER, POTENTIAL MEMBER OR PERSON 4 PLEDGED TO BE A MEMBER OF A GROUP OR ORGANIZATION AS A CONDITION OR 5 PRECONDITION OF GAINING MEMBERSHIP IN THE GROUP OR ORGANIZATION, TO 6 EXCLUDE CERTAIN CURRICULAR ACTIVITIES OR ATHLETIC TEAMS OF OR WITHIN THE 7 SCHOOL FROM APPLICATION OF THE SECTION AND TO PROVIDE THAT A STUDENT WHO 8 VIOLATES THE PROVISIONS OF THE SECTION SHALL BE GUILTY OF A MISDEMEANOR. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 18-917, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 18-917. HAZING. (1) No student or member of a fraternity, sorority or 13 other living or social student group or organization organized or operating on 14 or near a school or college or university campus,for purposes of participat-15ing in student activities of the college or university,shall intentionally 16 haze or conspire to haze any member, potential member or person pledged to be 17 a member of the group or organization, as a condition or precondition of 18 attaining membership in the group or organization or of attaining any office 19 or status therein. 20 (2) As used in this section, "haze" means to subject a person to bodily 21 danger or physical harm or a likelihood of bodily danger or physical harm, or 22 to require, encourage, authorize or permit that the person be subjected to any 23 of the following: 24 (a) Total or substantial nudity on the part of the person; 25 (b) Compelled ingestion of any substance by the person; 26 (c) Wearing or carrying of any obscene or physically burdensome article 27 by the person; 28 (d) Physical assaults upon or offensive physical contact with the person; 29 (e) Participation by the person in boxing matches, excessive number of 30 calisthenics, or other physical contests; 31 (f) Transportation and abandonment of the person; 32 (g) Confinement of the person to unreasonably small, unventilated, unsan- 33 itary or unlighted areas; 34 (h) Sleep deprivation; or 35 (i) Assignment of pranks to be performed by the person. 36 (3) Subsection (1) of this section does not apply to curricular activi- 37 ties or to athletic teams of or within the school, college or university. 38 (4) A student or member of a fraternity, sorority or other student orga- 39 nization, who personally violates any provision of this section shall be 40 guilty of a misdemeanor.
