  1                                        AN ACT
  2    RELATING TO CERTIFIED SHORTHAND REPORTERS;  AMENDING  SECTION  54-3110,  IDAHO
  3        CODE, TO INCREASE MAXIMUM RENEWAL FEES AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  That  Section 54-3110, Idaho Code, be, and the same is hereby
  6    amended to read as follows:
                                                                        
  7        54-3110.  FEES. The board shall be entitled to charge and collect the fol-
  8    lowing fees:
  9        (a)  The sum of fifty dollars ($50.00) as an application fee for any  tem-
 10    porary or regular certificate.
 11        (b)  The  sum  of  fifty  dollars  ($50.00)  as an examination fee for the
 12    administration of the reporters' examination to any applicant.
 13        (c)  A sum not to exceed forty two hundred dollars ($40.200) as a  renewal
 14    fee for any regular or temporary certificate.
 15        (d)  A sum not to exceed forty dollars ($40.00) as a reinstatement fee for
 16    any  application for reinstatement of a temporary or regular certificate which
 17    has been revoked or suspended.
 18        (e)  The failure to renew a certificate annually as provided in this  sec-
 19    tion and sections 54-3108 and 54-3109, Idaho Code, shall not deprive such per-
 20    son  of the right of renewal, but the fee to be paid for the renewal of a cer-
 21    tificate after the due date shall be increased twenty per cent  percent  (20%)
 22    for each month or fraction of a month that payment of renewal is delayed; pro-
 23    vided,  however,  that  the  maximum  fee for delayed renewal shall not exceed
 24    twice the renewal fee for each year delinquent, but in no event more than  one
 25    four hundred dollars ($1400).

                     STATEMENT OF PURPOSE

In order to permit the Board of Certified Shorthand Reporters to
continue to fulfill its statutory mandate to protect the public
welfare through licensing and enforcement activities, it is
necessary to increase the previously established cap on the amount
that the board can charge for renewal fees.  Increasing the cap
rate on renewals will provide the board with the flexibility to
adopt, by rule, renewal fees that exceed the currently established
amounts.  In addition, the legislation will increase the cap rate
for the total amount that may be charged in the event of a delayed
renewal from one hundred to four hundred dollars.



                         FISCAL IMPACT

In the event that the board were to adopt a fee increasing the
amount of the renewal to the maximum cap amount proposed ($200.00),
given the current number of licensees (233), the amount of revenue
generated would be approximately $46,600.00.
