2 RELATING TO THE SELECTION OF PRESIDENTIAL ELECTORS; AMENDING SECTION 34-606,
3 IDAHO CODE, TO PROVIDE FOR SELECTION OF PRESIDENTIAL ELECTORS; AMENDING
4 SECTION 34-1501, IDAHO CODE, TO PROVIDE FOR CERTIFICATES OF SELECTION TO
5 BE ISSUED AND TO MAKE A TECHNICAL CORRECTION; REPEALING SECTION 34-1502,
6 IDAHO CODE; AND AMENDING CHAPTER 15, TITLE 34, IDAHO CODE, BY THE ADDITION
7 OF A NEW SECTION 34-1502, IDAHO CODE, TO ESTABLISH THE PROCEDURE FOR DES-
8 IGNATION OF PRESIDENTIAL AND VICE-PRESIDENTIAL ELECTORS.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 34-606, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 34-606. SELECTION OF PRESIDENTIAL ELECTORS. (1) At the general election,
13 1972 2008, and every four (4) years thereafter, there shall be elected such a
14 number of electors of president and vice president of the United States as the
15 state may be entitled to in the electoral college. For each presidential and
16 vice-presidential ticket, one (1) presidential elector shall be designated
17 from each congressional district, and two (2) presidential electors shall be
18 chosen at large.
19 (2) No person shall be selected to this the position of presidential
20 elector unless he has attained the age of twenty-one (21) years at the time of
21 the selection, is a citizen of the United States and shall have resided within
22 the state two (2) years next preceding his selection.
23 (3) Such electors shall be certified to the secretary of state as pro-
24 vided for by law.
25 SECTION 2. That Section 34-1501, Idaho Code, be, and the same is hereby
26 amended to read as follows:
27 34-1501. CERTIFICATES OF SELECTION. The secretary of state shall prepare
28 lists of the names of the electors of president and vice-president vice presi-
29 dent of the United States, selected at pursuant to results of any election,
30 procure thereto the signature of the governor, affix the seal of the state to
31 the same, and deliver one (1) of such certificates thus signed to each of said
32 the electors on or before the second Wednesday in December next after such the
33 election.
34 SECTION 3. That Section 34-1502, Idaho Code, be, and the same is hereby
35 repealed.
36 SECTION 4. That Chapter 15, Title 34, Idaho Code, be, and the same is
37 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
38 ignated as Section 34-1502, Idaho Code, and to read as follows:

1 34-1502. DETERMINATION OF ELECTORS. Each at-large elector shall cast his
2 or her ballot for the presidential and vice-presidential candidates who
3 received the highest number of votes in the state. Each congressional district
4 presidential elector shall cast his or her ballot for the presidential and
5 vice-presidential candidates who received the highest number of votes in his
6 or her congressional district.
STATEMENT OF PURPOSE
RS 14752
This legislation amends Idaho Code to provide for
selection of presidential and vice-presidential electors and
to issue certificates of selection. It designates that at-
large electors shall cast his or her ballot for the
candidates who received the highest number of votes in the
state and that each congressional district presidential
elector shall cast his or her ballot for the candidates who
received the highest number of votes in his or her
congressional district.
