  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State  of  Idaho  assembled  in  the First Regular Session of the Fifty-eighth
  7    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS, citizens of the state of Idaho strongly believe that basic  civil
  9    liberties  must  be  preserved and protected, even as we seek to guard against
 10    terrorist and other threats to the national security; and
 11        WHEREAS, there are some principles of our democracy which are so fundamen-
 12    tal to the rights of citizenship that they must be preserved to guard the very
 13    liberties we seek to protect; and
 14        WHEREAS, legislation known as the SAFE Act has been introduced in the Con-
 15    gress of the United States to adopt amendments to the Patriot Act which  would
 16    address some of the most problematic provisions of that Act; and
 17        WHEREAS,  the  SAFE  Act  amends  the Patriot Act to modify the provisions
 18    regarding the roving wiretaps to require that the identity of  the  target  be
 19    given  and  that  the  suspect be present during the time when surveillance is
 20    conducted; and
 21        WHEREAS, the SAFE Act revises  provisions  governing  search  warrants  to
 22    limit  the  circumstances  when  the  delay  of notice may be exercised and to
 23    require reports to the Congress when delays of notice are used; and
 24        WHEREAS, the SAFE Act requires specific and  articulable  facts  be  given
 25    before  business records are subject to investigation by the Federal Bureau of
 26    Investigation; and
 27        WHEREAS, the SAFE Act provides that libraries shall not be treated as com-
 28    munication providers subject to providing information and transaction  records
 29    of the library patrons; and
 30        WHEREAS,  it is appropriate that the Legislature of the State of Idaho, on
 31    behalf of the citizens of Idaho, express support of  the  efforts  of  Senator
 32    Larry Craig to adopt the SAFE Act, and encourage the full support of the Idaho
 33    congressional delegation.
 34        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 35    of  the  Fifty-eighth  Idaho Legislature, the House of Representatives and the
 36    Senate concurring therein, that the Idaho Legislature endorses the efforts  to
 37    amend  the  Patriot  Act to assure that it works well to protect our security,
 38    but that it does not unnecessarily compromise essential liberties of the citi-
 39    zens of the United States. We urge the congressional  delegation  representing
 40    the State of Idaho in the Congress of the United States to support legislation
 41    introduced by Senator Larry Craig, known as the SAFE Act.

                      STATEMENT OF PURPOSE

The purpose of this Joint Memorial is, in effect, that the Idaho
Legislature endorses the efforts of Senator Larry Craig to amend
the Patriot Act to assure that it works well to protect our
security, but that it does not unnecessarily compromise essential
liberties of the citizens of the United States.


 
                           FISCAL NOTE

There will be no impact on the General Fund.
