  1                                        AN ACT
  2    RELATING TO EXHIBITIONS OF DOGFIGHTS; AMENDING SECTION 25-3507, IDAHO CODE, TO
  3        PROVIDE THAT PERSONS  WHO  KNOWINGLY  PARTICIPATE  IN  CERTAIN  ACTIVITIES
  4        RELATED  TO  DOGFIGHTING  EXHIBITIONS  SHALL  BE GUILTY OF A FELONY AND TO
  5        EXEMPT FROM APPLICATION CERTAIN ACTIVITIES.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 25-3507, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        25-3507.  EXHIBITION OF DOGFIGHTS. (1) Every A person shall be guilty of a
 10    felony  who  participates in a public or private display of combat between two
 11    (2) or more dogs knowingly:
 12        (a)  Owns, possesses, keeps, buys, sells, advertises  or  trains  any  dog
 13        with  the  intent  that  such  dog  shall  be  engaged in an exhibition of
 14        dogfighting in which the fighting, killing, maiming or injuring of dogs is
 15        a significant feature; or
 16        (b)  Who promotes, organizes, conducts, participates in  or  performs  any
 17        service  in  the  furtherance of an exhibition of dogfighting in which the
 18        fighting, killing, maiming or injuring of dogs is a  significant  feature.
 19        is  guilty  of  a  misdemeanor  and shall, upon conviction, be punished in
 20        accordance with section 25-3520A, Idaho Code.
 21        (2)  Nothing in this section prohibits:
 22        (a)  Ddemonstrations of the hunting, herding, working or  tracking  skills
 23        of dogs; or
 24        (b)  Tthe  lawful  use  of dogs for hunting, herding, working, tracking or
 25        self and property protection; or
 26        (c)  The training, raising, breeding or keeping of dogs  for  any  purpose
 27        not prohibited by law.

                       STATEMENT OF PURPOSE

                             RS 15719

The purpose of this legislation is to amend Section 25-3507,
Idaho Code, to make dog fighting a felony, to define dog
fighting, and to provide punishment.


                           FISCAL NOTE

There would be no impact of the General Fund.
