6 SUCH OTHER QUALIFICATIONS DEEMED NECESSARY BY THE BOARD AND TO MAKE TECH-
7 NICAL CORRECTIONS; AMENDING SECTION 54-2606, IDAHO CODE, TO REQUIRE THE
8 IDAHO PLUMBING BOARD TO ESTABLISH BY RULE THE CURRICULUM TO BE USED IN
9 APPRENTICESHIP TRAINING PROGRAMS, THE QUALIFICATIONS NECESSARY TO ATTAIN
10 JOURNEYMAN STATUS AND SUCH OTHER QUALIFICATIONS DEEMED NECESSARY BY THE
11 BOARD; AND AMENDING SECTION 54-5005, IDAHO CODE, TO REQUIRE THE IDAHO
12 HEATING, VENTILATION AND AIR CONDITIONING BOARD TO ESTABLISH BY RULE THE
13 CURRICULUM TO BE USED IN APPRENTICESHIP TRAINING PROGRAMS, THE QUALIFICA-
14 TIONS NECESSARY TO ATTAIN JOURNEYMAN STATUS AND SUCH OTHER QUALIFICATIONS
15 DEEMED NECESSARY BY THE BOARD AND TO REFORMAT THE SECTION.
16 Be It Enacted by the Legislature of the State of Idaho:
17 SECTION 1. That Section 54-1006, Idaho Code, be, and the same is hereby
18 amended to read as follows:
19 54-1006. IDAHO ELECTRICAL BOARD. (1) The Idaho electrical board, herein-
20 after known as the board, is hereby created and made a part of the division of
21 building safety. It shall be the responsibility and duty of the administrator
22 of the division of building safety to administer and enforce the provisions of
23 this act, and to serve as secretary to the Idaho electrical board.
24 (2) The board shall consist of nine (9) members to be appointed by the
25 governor with power of removal for cause. Two (2) members shall be licensed
26 journeymen or master electricians; two (2) members shall be employees or offi-
27 cers of licensed electrical contractors; one (1) member shall be a licensed
28 specialty journeyman or contractor; one (1) member shall be an employee or
29 officer of an electrical power provider; one (1) member shall be an employee
30 or officer of a manufacturing plant or other large power user; one (1) member
31 shall be an employee or director of a manufacturer or distributor of electri-
32 cal supplies or materials; and one (1) member shall be from the public at
33 large not directly associated with the electrical industry. Board members
34 shall be appointed for a term of four (4) years. Members of the board shall
35 hold office until expiration of the term to which the member was appointed and
36 until his successor has been duly appointed and qualified. Whenever a vacancy
37 occurs, the governor shall appoint a qualified person to fill the vacancy for
38 the unexpired portion of the term.
39 (3) All members of the board shall be citizens of the United States, res-
40 idents of this state for not less than two (2) years and shall be qualified by
41 experience, knowledge and integrity in formulating rules for examinations, in
42 passing on the fitness and qualifications of applicants for electrical con-
43 tractor and journeyman electrician licenses and in establishing standards for

1 electrical products to be used in electrical installations coming under the
2 provisions of this act chapter.
3 (4) The members of the board shall, at their first regular meeting fol-
4 lowing the effective date of this act chapter and every two (2) years thereaf-
5 ter, elect by majority vote of the members of the board, a chairman who shall
6 preside at meetings of the board. In the event the chairman is not present at
7 any board meeting, the board may by majority vote of the members present
8 appoint a temporary chairman. A majority of the members of the board shall
9 constitute a quorum.
10 (5) The board is authorized and directed to prescribe and amend rules
11 consistent with this act chapter for the administration of this chapter and to
12 effectuate the purpose thereof, and for shall provide for the following:
13 (a) Tthe examination and licensing of electrical contractors, journeyman
14 electricians, master electricians, specialty electricians, specialty elec-
15 trical contractors, specialty electrical trainees and apprentice electri-
16 cians;. The board shall also establish
17 (b) Tthe classifications for specialty electrician and specialty electri-
18 cal contractor licensing and the fees to be charged for permits and
19 inspections of electrical systems;. The board shall establish by adminis-
20 trative rule
21 (c) Tthe fines to be paid for citations issued; and
22 (d) The curriculum to be used in apprenticeship training programs, the
23 qualifications necessary to attain journeyman status, and such other qual-
24 ifications deemed necessary by the board.
25 (6) The board shall hear appeals regarding the imposition of civil penal-
26 ties for violations of this chapter and the rules of the Idaho electrical
27 board. The board is authorized to affirm, reject, decrease or increase the
28 penalty imposed by the administrator. However, in no case shall the penalty
29 exceed one thousand dollars ($1,000) for each offense.
30 (67) Each member of the board not otherwise compensated by public moneys
31 shall be compensated as provided by section 59-509(h), Idaho Code.
32 SECTION 2. That Section 54-2606, Idaho Code, be, and the same is hereby
33 amended to read as follows:
34 54-2606. POWERS AND DUTIES OF THE IDAHO PLUMBING BOARD. (1) The board
35 shall have the general administration and supervision of the design, construc-
36 tion, installation, improvement, extension and alteration of plumbing and
37 plumbing systems, except that which has been heretofore and hereinafter
38 exempted from the jurisdiction of this board, in connection with all build-
39 ings, residences and structures in this state including buildings, residences
40 and structures owned by the state or any political subdivision thereof.
41 (2) The division of building safety shall enforce the minimum standards
42 and requirements therefor as provided by this chapter.
43 (3) The board may exercise such powers and duties as are reasonably nec-
44 essary to carry out the provisions of this chapter, and it may among other
45 things:
46 (a) Establish the fees to be charged for permits and inspections of
47 plumbing systems.
48 (b) Hold public meetings and attend or be represented at such meetings,
49 within or without the state, prepare and publish rules pertaining to this
50 chapter, and such other information as may be necessary, and furnish cop-
51 ies thereof to those engaged in the business, trade, practice or work of
52 plumbing and pipefitting and to the public upon request.
53 (c) Furnish standards and procedures and prescribe reasonable rules for

1 examinations, qualification and certification of plumbing contractors and
2 journeymen and apprentice plumbers not herein prescribed, including the
3 furnishing of a compliance bond in an amount not to exceed two thousand
4 dollars ($2,000) for the contractor classification or evidence of such
5 coverage by a corporate industry group bond acceptable to the board.
6 (d) Furnish standards and procedures and prescribe reasonable rules to
7 provide for the certification of specialty contractors, specialty jour-
8 neymen, and specialty apprentices, including the furnishing of a compli-
9 ance bond in an amount not to exceed two thousand dollars ($2,000) for the
10 specialty contractor classification or evidence of coverage by a corporate
11 industry group bond acceptable to the board.
12 (e) Establish by administrative rule civil penalties not to exceed one
13 thousand dollars ($1,000) for each count or separate offense, to be paid
14 for violations of this chapter and rules of the Idaho plumbing board; and
15 to establish by administrative rule the process by which appeals from the
16 imposition of civil penalties may be heard. The board is authorized to
17 affirm, reject, decrease or increase the penalty imposed; however, the
18 board shall not increase any penalty imposed to an amount exceeding one
19 thousand dollars ($1,000) for each individual count or separate offense.
20 (4) The board shall establish by administrative rule the curriculum to be
21 used in apprenticeship training programs, the qualifications necessary to
22 attain journeyman status, and such other qualifications deemed necessary by
23 the board.
24 SECTION 3. That Section 54-5005, Idaho Code, be, and the same is hereby
25 amended to read as follows:
26 54-5005. POWERS AND DUTIES OF THE BOARD -- LIMITATION. (1) The board
27 shall have the general administration and supervision of the design, construc-
28 tion, installation, improvement, extension and alteration of heating, ventila-
29 tion and air conditioning systems, except that which has been heretofore and
30 hereinafter exempted from the jurisdiction of this board, in connection with
31 all buildings, residences and structures in this state including buildings,
32 residences and structures owned by the state or any political subdivision
33 thereof. The division of building safety shall enforce the minimum standards
34 and requirements therefor as provided by this chapter. The board may exercise
35 such powers and duties as are reasonably necessary to carry out the provisions
36 of this chapter, and it may, among other things:
37 (1a) Establish the fees to be charged for reviewing plans, investiga-
38 tions, permits and inspections of heating, ventilation and air condition-
39 ing systems under the jurisdiction of the state, and to establish such
40 other fees as it deems necessary.
41 (2b) Hold public meetings and attend or be represented at such meetings,
42 within or without the state, prepare and publish rules pertaining to this
43 chapter, and such other information as may be necessary, and furnish cop-
44 ies thereof to those engaged in the business, trade, practice or work of
45 heating, ventilation and air conditioning and to the public upon request.
46 (3c) Establish by administrative rule the fines to be paid for citations

49 rized to affirm, reject, decrease or increase the penalty imposed by the

52 (2) The board shall establish by administrative rule the curriculum to be
53 used in apprenticeship training programs, the qualifications necessary to

1 attain journeyman status, and such other qualifications deemed necessary by
2 the board.
3 (3) The powers and duties of the board within the jurisdictional bound-
4 aries of local governments that have chosen to adopt and enforce mechanical
5 codes shall be limited to those powers and duties needed to enforce the
6 requirements governing a certificate of competency. Each local government that
7 has chosen to adopt and enforce mechanical codes shall establish fees to be
8 charged for permits and inspections within its jurisdiction.
STATEMENT OF PURPOSE
RS 15840
This legislation amends sections of Idaho code to require the Idaho
Electrical Board, Idaho Plumbing Board, and the Idaho Heating,
Ventilation and Air Conditioning Board to approve the curriculum
and qualifications to attain journeyman status in specific trades.
Consideration of U.S. Department of Labor certified curriculum
would allow Idaho journeymen to acquire licensing in other states
with the nationally approved curriculum.
