  1                                        AN ACT
  2    RELATING TO COUNTY APPORTIONMENT OF FOREST  RESERVE  FUNDS;  AMENDING  SECTION
  3        57-1303, IDAHO CODE, TO REVISE THE DISTRIBUTION FORMULA FOR FOREST RESERVE
  4        FUNDS  RECEIVED  BY   SCHOOL  DISTRICTS  WITHIN  A COUNTY RECEIVING FOREST
  5        RESERVE FUNDS, TO DELETE AN ARCHAIC TERM AND  TO  MAKE  TECHNICAL  CORREC-
  6        TIONS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 57-1303, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        57-1303.  COUNTY APPORTIONMENT OF FOREST RESERVE  FUNDS.  The  auditor  of
 11    each  county  receiving  a  portion of this fund shall within ten (10) days of
 12    receipt of this money allot and distribute seventy per cent percent  (70%)  of
 13    this money to the county general road fund and to the treasurer of the highway
 14    districts  and  good road districts in the county in proportion to the mileage
 15    of each within the county, to be expended for the construction and  repair  of
 16    roads  and bridges, and thirty per cent fifteen percent (3015%) to the various
 17    school districts and joint county school districts within the county  in  pro-
 18    portion  to  the number of pupils in average daily attendance in each district
 19    in the year immediately prior to this distribution and fifteen  percent  (15%)
 20    to  the  various school districts in the county in proportion to the amount of
 21    U.S. forest service land the school  district  contains  bears  to  the  total
 22    amount  of the U.S. forest service land in all school districts of the county.
 23    The distribution of such moneys to the respective  school  districts  entitled
 24    thereto  shall  be in addition to and without regard to any assistance to such
 25    school districts from any and all other sources  in  maintaining  the  minimum
 26    educational program and minimum transportation program.

                       STATEMENT OF PURPOSE

This legislation would change the distribution formula of Forest
Reserve Funds to school districts that have large areas of Forest
Service lands within their borders.
