  1                                        AN ACT
  2    RELATING TO CORONERS; AMENDING CHAPTER 28, TITLE 31, IDAHO CODE, BY THE  ADDI-
  3        TION OF A NEW SECTION 31-2810, IDAHO CODE, TO REQUIRE AUTOPSIES TO BE PER-
  4        FORMED  IN  CERTAIN  CASES IN WHICH CREUTZFELDT-JAKOB DISEASE IS SUSPECTED
  5        AND TO REQUIRE THAT THE FINDINGS OF SUCH  AUTOPSIES  BE  REPORTED  TO  THE
  6        DEPARTMENT OF HEALTH AND WELFARE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Chapter  28,  Title 31, Idaho Code, be, and the same is
  9    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 10    ignated as Section 31-2810, Idaho Code, and to read as follows:
                                                                        
 11        31-2810.  AUTOPSIES.  When an attending physician or hospital has reported
 12    to the department of health and welfare that Creutzfeldt-Jakob  disease  (CJD)
 13    or  variant  CJD  is suspected in relation to a person's death, the coroner in
 14    the county in which the person died shall perform, or cause to  be  performed,
 15    an  autopsy  of  the  body,  provided a definitive diagnosis has not been made
 16    prior to death, and shall report the findings of such autopsy to  the  depart-
 17    ment of health and welfare.

This legislation proposes adding an new section to Chapter 28 of
Title 31 of the Idaho Code to require that autopsies be performed
in cases in which Creutzfeldt-Jakob Disease is suspected, and to
require that the findings of such autopsies be reported to the
Department of Health and Welfare.



                           FISCAL NOTE

Each autopsy will cost $1,000, which will be paid for by the
Center for Disease Control and can be done through Case Western
University should the family/coroner desire.
