2 RELATING TO PLUMBING; AMENDING SECTION 54-2611, IDAHO CODE, TO REVISE PROVI-
3 SIONS APPLICABLE TO CLASSIFICATIONS OF COMPETENCY, TO PROVIDE FOR RESIDEN-
4 TIAL PLUMBING JOURNEYMEN, TO PROVIDE CORRECT TERMINOLOGY AND TO MAKE TECH-
5 NICAL CORRECTIONS; AMENDING SECTION 54-2614, IDAHO CODE, TO PROVIDE FOR AN
6 APPLICATION FEE; AND AMENDING SECTION 54-2616, IDAHO CODE, TO PROVIDE FOR
7 A CERTIFICATE FEE.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 54-2611, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 54-2611. CLASSIFICATION OF COMPETENCY. There shall be three four (34)
12 classifications of competency in the business, trade, practice or work of
13 plumbing and three (3) classifications of competency in the business, trade,
14 practice or work of specialty plumbing, as follows:
15 (a1) A plumbing contractor shall be any person, or a member, representa-
16 tive or agent of a firm, copartnership, association, or corporation skilled in
17 the planning and supervision of the construction, installation, improvement,
18 extension and alteration of plumbing systems, and who is familiar with the
19 provisions of this act chapter and the rules made by the Idaho plumbing board,
20 and who is competent to offer and to assume to work on a contract basis and to
21 direct the work of qualified employees. A contractor who in person does plumb-
22 ing work shall also be qualified as a journeyman plumber, or have in his
23 employ on all work a qualified journeyman.
24 (b2) A plumbing journeyman shall be any person, who as his principal
25 occupation, is engaged in the installation, improvement, extension and altera-
26 tion of plumbing systems, and who is familiar with the provisions of this act
27 chapter and who works in the employ and under the direction of a plumbing con-
28 tractor.
29 (c3) A plumbing apprentice shall be any person, who as his principal
30 occupation is engaged in learning and assisting in installation, improvement,
31 extension and alteration of plumbing systems. Apprentices shall not perform
32 plumbing work except under the supervision of a journeyman.
33 (4) A residential plumbing journeyman shall be any person who is engaged
34 in the installation, improvement, extension and alteration of plumbing systems
35 of residential properties only, other than such plumbing as may otherwise be
36 exempted pursuant to section 54-2602, Idaho Code, and who is familiar with the
37 provisions of this chapter and is competent as evidenced to the board by exam-
38 ination, provided that the issuance of a certificate of competency to a resi-
39 dential plumbing journeyman shall not be made dependent upon the completion of
40 any specified number of hours of plumbing work performed or the completion of
41 specified education requirements.
42 (d5) A specialty contractor shall be any person, or a member, representa-
43 tive or agent of a firm, copartnership, association, or corporation skilled in

1 the specialty classification for which he is certified and who is familiar
2 with the provisions of this act chapter and rules made by the Idaho plumbing
3 board, and who is competent to offer and to assume work on a contract basis
4 and to direct the work of qualified employees. A specialty contractor who in
5 person does specialty work shall also be qualified as a specialty journeyman,
6 or have in his employ on all work a specialty journeyman.
7 (e6) A specialty journeyman shall be any person who is engaged in the
8 specialty classification for which he is certified and who is familiar with
9 the provisions of this act chapter and who works in the employ and under the
10 direction of a plumbing or specialty contractor.
11 (f7) A specialty apprentice shall be any person who is engaged in learn-
12 ing and assisting in the specialty classification for which he is registered.
13 Specialty apprentices shall not perform specialty work except under supervi-
14 sion of a specialty journeyman.
15 SECTION 2. That Section 54-2614, Idaho Code, be, and the same is hereby
16 amended to read as follows:
17 54-2614. APPLICATION AND REGISTRATION FEES. All applicants shall pay to
18 the board at the time of application for examination, a fee in accordance with
19 the following:
20 Application for Plumbing Contractor.................................$22.50
21 Application for Plumbing Journeyman................................. 22.50
22 Application for Residential Plumbing Journeyman..................... 22.50
23 Application for Specialty Contractor................................ 22.50
24 Application for Specialty Journeyman................................ 22.50
25 Apprentices and specialty apprentices shall not be required to be examined for
26 competency, but shall register with the board and maintain such registration
27 yearly. The registration fee for apprentices and specialty apprentices shall
28 be five dollars ($5.00) initial and five dollars ($5.00) per year renewal. The
29 board may contract with a professional testing service to administer any
30 licensing examination and any contracted professional testing service shall be
31 responsible to establish and collect the examination fee. Any person who fails
32 to pass the examination may apply for reexamination at the next scheduled
33 examination upon payment of the examination fee. Should any person fail to
34 pass the examination the second time, the board may refuse to allow a subse-
35 quent examination until the expiration of one (1) year.
36 SECTION 3. That Section 54-2616, Idaho Code, be, and the same is hereby
37 amended to read as follows:
38 54-2616. FEES FOR CERTIFICATES -- PRORATING. (1) Before a certificate is
39 issued, and for the renewal thereof, the successful applicant shall pay to the
40 division of building safety a fee in accordance with the following schedule:
41 Initial Fee Renewal
42 Plumbing Contractor $75.00 $36.00
43 Plumbing Journeyman 15.00 7.20
44 Residential Plumbing Journeyman 15.00 7.20
45 Specialty Contractor 75.00 36.00
46 Specialty Journeyman 15.00 7.20
47 (2) The administrator of the division of building safety shall have the
48 authority to prorate and assess the initial certificate fees as follows: the
49 amount of the initial fee, plus the product of one-twelfth (1/12) of the
50 amount of the renewal fee for that particular category of certificate multi-
51 plied by the number of months in excess of twelve (12) for which the certifi-

1 cate is issued. No certificate shall be issued for less than twelve (12)
2 months.
3 (3) The administrator of the division of building safety shall have the
4 authority to prorate and assess the renewal fees as follows: the number of
5 months the certificate will be in effect, multiplied by one-twelfth (1/12) of
6 the renewal fee for that particular category of certificate. No renewal shall
7 be issued for less than twelve (12) months.

The purpose of this legislation is to provide for another
classification for plumbing which is a residential plumbing
Journeyman licence for this less inclusive classification. It
provides for another process to acquire a residential plumbing
Journeyman's license for proficient plumbers.
