SCHOLARSHIPS - Adds to and amends existing law to provide that the amount
of the proceeds of the license tax on electricity distributed to the
General Fund be distributed to the Center for Advanced Energy Studies
Scholarship Fund instead; to create the Center for Advanced Energy Studies
Scholarship Fund; to provide moneys for the fund; to provide procedures for
providing scholarships; to provide duties of the State Board of Education
and the Board of Regents of the University of Idaho; to provide for
interest on moneys invested from the fund to be returned to the fund; and
to clarify that the State Board of Education and the Board of Regents of
the University of Idaho may accept grants and gifts on behalf of a

  2    RELATING TO  SCHOLARSHIPS;  PROVIDING  LEGISLATIVE  INTENT;  AMENDING  SECTION
  3        63-2702,  IDAHO  CODE,  TO PROVIDE FOR DISTRIBUTION OF THE PROCEEDS OF THE
  4        LICENSE TAX ON ELECTRICITY TO BE DISTRIBUTED TO THE  CENTER  FOR  ADVANCED
  5        ENERGY STUDIES SCHOLARSHIP FUND INSTEAD OF THE GENERAL ACCOUNT AND TO MAKE
  6        A  TECHNICAL CORRECTION; AMENDING CHAPTER 43, TITLE 33, IDAHO CODE, BY THE
  7        ADDITION OF A NEW SECTION 33-4316, IDAHO CODE, TO CREATE  THE  CENTER  FOR
  8        ADVANCED  ENERGY STUDIES SCHOLARSHIP FUND, TO PROVIDE MONEYS FOR THE FUND,
  9        TO PROVIDE PROCEDURES FOR PROVIDING SCHOLARSHIPS, TO PROVIDE DUTIES OF THE
 10        STATE BOARD OF EDUCATION AND THE BOARD OF REGENTS  OF  THE  UNIVERSITY  OF
 11        IDAHO  AND  TO PROVIDE FOR INTEREST ON MONEYS INVESTED FROM THE FUND TO BE
 12        RETURNED TO THE FUND; AND AMENDING SECTION 33-3714, IDAHO CODE, TO CLARIFY
 13        THAT THE STATE BOARD OF EDUCATION AND THE BOARD OF REGENTS OF THE  UNIVER-
 14        SITY OF IDAHO MAY ACCEPT GRANTS AND GIFTS ON BEHALF OF A SCHOLARSHIP FUND.
                                                                        
 15    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 16        SECTION  1.  LEGISLATIVE  INTENT.  It  is  the purpose of this act to show
 17    Idaho as an energy leader through partnering  with  the  Center  for  Advanced
 18    Energy  Studies  at the Idaho National Laboratory by providing scholarships to
 19    the next generation of Idaho high school or college scientists, engineers  and
 20    technicians  and  to  aid  Idaho  universities'  and  colleges'  professional-
 21    technical programs in becoming world class centers for engineering and science
 22    education and technical training.
 23        The world is facing energy-related challenges regarding world and national
 24    energy demands, advanced science and energy technology delivery, nuclear engi-
 25    neering educational shortfalls and adequately trained technical staff. Resolu-
 26    tion of these issues is important for the United States to ensure a secure and
 27    affordable  energy  supply  which  is  essential for maintaining United States
 28    national security, continued economic prosperity and future sustainable devel-
 29    opment.
 30        A BEST (Building Engineering and Science Talent) Report noted that twenty-
 31    five percent of U.S. scientists and engineers will  reach  retirement  age  by
 32    2010. In nuclear, seventy-five percent of nuclear personnel currently employed
 33    by  the  Department  of Energy national laboratories are eligible to retire by
 34    2010. Also, forty percent of the current technician work force is expected  to
 35    retire within the next five to seven years.
 36        It  is  intended  that the recipients of scholarships pursuant to this act
 37    will study in areas to ensure U.S. energy security,  including  affordability,
 38    limited  environmental  impacts,  and  leadership  in the global energy arena.
 39    Energy technologies to be addressed include those for nuclear, hydrogen, coal,
 40    oil, natural gas and renewable energy sources.
                                                                        
 41        SECTION 2.  That Section 63-2702, Idaho Code, be, and the same  is  hereby
 42    amended to read as follows:

  1        63-2702.  PAYMENT  OF TAX -- DISTRIBUTION OF REVENUE -- INTEREST ON DELIN-
  2    QUENCIES. (1) Said license tax shall be remitted with the  statement  required
  3    under section 63-2701, Idaho Code, and paid to the state tax commission, which
  4    shall distribute all moneys as follows:
  5        (2)  An  amount  of money shall be distributed to the state refund account
  6    sufficient to pay current refund claims. All refunds authorized by  the  state
  7    tax commission to  be paid shall be paid through the state refund account, and
  8    those  moneys  are  hereby  continuously  appropriated  for that purpose. Such
  9    refunds shall be authorized for the  purpose  of  repaying  overpayments  made
 10    under  this chapter, for the purpose of repaying any tax, penalty, or interest
 11    illegally assessed or collected, or for the purpose of  paying  any  judgement
 12    judgment  rendered  against  the  state tax commission under the provisions of
 13    this chapter.
 14        (3)  The balance shall be distributed to the general  account  center  for
 15    advanced  energy  studies  scholarship  fund created in section 33-4316, Idaho
 16    Code.
 17        (4)  Taxes not paid on the due date shall become delinquent and shall bear
 18    interest from said due date at the rate provided  in  section  63-3045,  Idaho
 19    Code.
                                                                        
 20        SECTION  3.  That  Chapter  43,  Title 33, Idaho Code, be, and the same is
 21    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 22    ignated as Section 33-4316, Idaho Code, and to read as follows:
                                                                        
 23        33-4316.  CENTER  FOR  ADVANCED ENERGY STUDIES SCHOLARSHIP FUND. (1) There
 24    is hereby created in the state treasury the center for advanced energy studies
 25    scholarship fund. The fund shall be administered by the state board of  educa-
 26    tion  and the board of regents of the university of Idaho and shall consist of
 27    moneys from section 63-2702, Idaho Code, grants, donations, pledges or  moneys
 28    from  any  other source. Moneys in the fund may be expended pursuant to appro-
 29    priation, and shall be utilized to advance the education of the  next  genera-
 30    tion of Idaho scientists, engineers and technicians with scholarships to Idaho
 31    colleges  and  universities,  to  provide  students with skills and experience
 32    needed to address critical work force needs in energy areas and to  aid  Idaho
 33    postsecondary institutions in becoming world class centers for engineering and
 34    science education and training.
 35        (2)  The  state board of education and the board of regents of the univer-
 36    sity of Idaho shall promulgate rules in compliance with chapter 52, title  67,
 37    Idaho  Code,  outlining  eligibility  for potential scholarship recipients and
 38    shall also state the minimum grade point average and academic progress  neces-
 39    sary  for  renewal  of a scholarship. The provisions of section 33-4315, Idaho
 40    Code, apply to all scholarships awarded pursuant to this section.
 41        (3)  The state board of education and the board of regents of the  univer-
 42    sity of Idaho shall present an annual report no later than the first Monday in
 43    January of each year to the governor, the joint finance-appropriations commit-
 44    tee,  the  environment, energy and technology committee of the house of repre-
 45    sentatives, the education committees of the house of representatives  and  the
 46    senate  and  to the president pro tempore of the senate and the speaker of the
 47    house of representatives regarding the effectiveness of  scholarships  awarded
 48    pursuant to this section.
 49        (4)  The  state  treasurer  shall  invest  all moneys in the fund, and the
 50    interest earned on the investments shall be returned to the fund.
                                                                        
 51        SECTION 4.  That Section 33-3714, Idaho Code, be, and the same  is  hereby
 52    amended to read as follows:

  1        33-3714.  ACCEPTANCE  OF GIFTS, LEGACIES AND DEVISES. The board of regents
  2    of the University of Idaho and the state board of education are hereby  autho-
  3    rized  in  the name of any state educational institution or a scholarship fund
  4    and on behalf of the state or a scholarship fund, to  accept  gifts,  legacies
  5    and  devises  of  property  to the state for the use and benefit of any of the
  6    state educational institutions or a scholarship fund.

                       STATEMENT OF PURPOSE

The purpose of this legislation is to set up a scholarship fund for
the next generation of Idaho high school or college scientists,
engineers and technicians in partnership with the Center for Advanced
Energy Studies (CAES) at the Idaho National Lab, and Idaho colleges,
universities and professional-technical centers.

Twenty-five percent of U.S. scientists and engineers will reach
retirement age by 2010.  Forty percent of the current technician work
force is expected to retire within the next five to seven years.  In
nuclear, seventy-five percent of nuclear personnel currently employed
with the Department of Energy national laboratories are expected to
retire by 2010.

Idaho high school and college recipients of scholarships pursuant to
this act will study energy technologies in the areas of hydrogen,
nuclear, coal, oil, natural gas and renewable energy resources.
                   
              
                          FISCAL NOTE

Funding will be provided by the State's Kilowatt Hour Tax which brings
in about $1.5M per year which will reduce the general fund by this
