  2    RELATING TO POSTSECONDARY EDUCATION SCHOLARSHIPS; AMENDING CHAPTER  43,  TITLE
  3        33,  IDAHO  CODE, BY THE ADDITION OF A NEW SECTION 33-4318, IDAHO CODE, TO
  4        STATE LEGISLATIVE INTENT, TO CREATE AN IDAHO OPPORTUNITY SCHOLARSHIP  PRO-
  5        GRAM,  TO  PROVIDE FOR PROCEDURES, TO CREATE AN IDAHO OPPORTUNITY SCHOLAR-
  6        SHIP FUND IN THE STATE TREASURY WITH A ONE TIME APPROPRIATION OF TEN  MIL-
  7        LION DOLLARS AND TO DEFINE TERMS.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Chapter  43,  Title 33, Idaho Code, be, and the same is
 10    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 11    ignated as Section 33-4318, Idaho Code, and to read as follows:
                                                                        
 12        33-4318.  IDAHO  OPPORTUNITY SCHOLARSHIP PROGRAM. (1) Many of Idaho's stu-
 13    dents from low-income families are unable to attend Idaho postsecondary insti-
 14    tutions. Existing scholarship programs cannot provide the funding necessary to
 15    assist all such low-income students who qualify. As a  result,  Idaho  is  not
 16    providing  postsecondary educational opportunities to many students who simply
 17    lose the chance to improve themselves and provide a  greater  contribution  to
 18    Idaho  by  attending  an  Idaho  postsecondary  institution. It is legislative
 19    intent that the creation of a permanent fund to provide scholarships  to  low-
 20    income Idaho students will help remediate this problem.
 21        (2)  There is hereby created the Idaho opportunity scholarship program. An
 22    eligible  student  may apply to the board for an Idaho opportunity scholarship
 23    to an eligible postsecondary institution.
 24        (3)  The board shall implement and administer this scholarship program and
 25    shall promulgate rules necessary to do so, including rules for:
 26        (a)  Processing and approving scholarship applications from eligible  stu-
 27        dents;
 28        (b)  Determining, based on available funding, the number of Idaho opportu-
 29        nity  scholarships  based  upon need to be awarded each academic year, the
 30        duration of each such scholarship and the amount of each such scholarship;
 31        and
 32        (c)  Monitoring the progress of the eligible  student  in  that  student's
 33        academic performance to ensure that the student maintains enrollment at an
 34        eligible postsecondary institution on a full-time or part-time basis, pro-
 35        vided however, that for good cause shown, the board may permit the student
 36        to suspend the student's study for up to two (2) years.
 37        (4)  The Idaho opportunity scholarship fund is hereby created in the state
 38    treasury.  Income  from  the  fund shall be used to fund the Idaho opportunity
 39    scholarship program. The  fund  principal  shall  consist  of  appropriations,
 40    gifts,  grants,  donations  and  income from fund investment and interest. The
 41    legislature shall appropriate ten million  dollars  ($10,000,000)  for  fiscal
 42    year  2007  to the fund. Moneys in the fund shall not revert to any other fund
 43    at the end of the fiscal year.

  1        (5)  The following definitions shall apply to this section:
  2        (a)  "Board" means the state board of education.
  3        (b)  "Eligible postsecondary institution"  means  an  Idaho  public  post-
  4        secondary organization governed or supervised by the state board of educa-
  5        tion, the board of regents of the university of Idaho, a board of trustees
  6        of  a  community college established pursuant to the provisions of section
  7        33-2106, Idaho Code, or the state board for professional-technical  educa-
  8        tion  or  any  educational organization located in Idaho which is operated
  9        privately and not for profit under the control of an independent board and
 10        not directly controlled or administered by a public or political  subdivi-
 11        sion.
 12        (c)  "Eligible  student"  means  a student who has graduated from an Idaho
 13        secondary school and whose family income meets the percentage of the  fed-
 14        eral  poverty  level that the board has determined to qualify for an Idaho
 15        opportunity scholarship.

  2        On page 1 of the printed bill, in line  40,  delete  "The";  in  line  41,
  3    delete  "legislature  shall  appropriate ten million dollars ($10,000,000) for
  4    fiscal"; in line 42, delete "year 2007 to the fund."; and following  line  43,
  5    insert:
  6        "(5)  The  board  shall be responsible for acceptance of funds from public
  7    and private sources, and such funds may be expended pursuant to  appropriation
  8    to the board for expenditures consistent with this section.".
  9        On page 2, in line 1, delete "(5)" and insert: "(6)".
                                                                        
 10                                   CORRECTIONS TO TITLE
 11        On  page 1, in line 6, delete "WITH A ONE TIME APPROPRIATION OF TEN MIL-";
 12    and in line 7, delete "LION DOLLARS" and  insert:  ",  TO  PROVIDE  FOR  BOARD
 13    RESPONSIBILITY".

                       STATEMENT OF PURPOSE

This legislation relates to post-secondary education scholarships;
amending Chapter 43, Title 33, Idaho Code, by the addition of a new
section 33-4318, Idaho Code, to state legislative intent, to create
an Idaho Needs-Based Scholarship Program, to provide for
procedures, to create an Idaho-Needs Based Scholarship Fund in the
State Treasury with a one time appropriation of ten Million dollars
and to define terms.


                           FISCAL NOTE

There will be a one time impact of ten million dollars on the state
treasury.
