1 AN ACT
2 RELATING TO THE IDAHO BUILDING CODE BOARD; AMENDING SECTION 39-4106, IDAHO
3 CODE, TO REVISE BOARD MEMBERSHIP AND MEETING PROVISIONS.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 39-4106, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 39-4106. IDAHO BUILDING CODE BOARD CREATED -- MEMBERSHIP -- APPOINTMENT
8 -- TERMS -- QUORUM -- COMPENSATION -- MEETINGS. (1) The Idaho building code
9 board is established within the division as an appeals, code adoption and
10 rulemaking board, to be appointed by the governor, and shall consist of nine
11 twelve (912) members: one (1) member of the general public; one (1) local fire
12 official; one (1) registered engineer; one (1) licensed architect; two (2)
13 local building officials, one (1) from a county and one (1) from a city; one
14 (1) homebuilder or general contractor; one (1) representative of the modular
15 building industry; and one (1) individual with a disability from an organiza-
16 tion that represents people with all types of disabilities; and four (4)
17 homebuilders or general contractors who are duly licensed or registered in
18 accordance with Idaho Code, provided such homebuilders or general contractors
19 shall be appointed each from a geographical location as follows: one (1)
20 homebuilder or general contractor from the northern district consisting of
21 Idaho, Lewis, Nez Perce, Clearwater, Latah, Benewah, Boundary, Shoshone,
22 Kootenai and Bonner counties; one (1) homebuilder or general contractor from
23 the southeastern district consisting of Lemhi, Butte, Clark, Fremont, Jeffer-
24 son, Madison, Teton, Bonneville, Bingham, Caribou, Bear Lake, Franklin,
25 Oneida, Power and Bannock counties; one (1) homebuilder or general contractor
26 from the southwestern district consisting of Owyhee, Elmore, Ada, Canyon,
27 Boise, Gem, Payette, Washington, Adams and Valley counties; and one (1)
28 homebuilder or general contractor from the south central district consisting
29 of Blaine, Camas, Cassia, Custer, Gooding, Jerome, Lincoln, Minidoka and Twin
30 Falls counties. Board members shall be appointed for terms of four (4) years
31 and until their successor has been appointed. Three (3) consecutive failures
32 by a member to attend meetings of the board without reasonable cause shall
33 constitute cause for removal of the member from the board by the governor.
34 Whenever a vacancy occurs, the governor shall appoint a qualified person to
35 fill the vacancy for the unexpired portion of the term.
36 (2) The members of the board shall, at their first regular meeting fol-
37 lowing the effective date of this chapter and every two (2) years thereafter,
38 elect by majority vote of the members of the board, a chairman who shall pre-
39 side at meetings of the board. A majority of the currently appointed members
40 of the board shall constitute a quorum.
41 (3) Each member of the board not otherwise compensated by public moneys
42 shall be compensated as provided by section 59-509(h), Idaho Code, for each
43 day spent in attendance at meetings of the board.

1 (4) The board shall meet for regular business sessions at the call of the
2 administrator, or chairman, or at the request of four (4) a majority of the
3 members of the board, provided that the board shall meet at least biannually.
STATEMENT OF PURPOSE
RS 16252
This legislation would add three homebuilders or general
contractors to the Idaho Building Code Board. Further, each
general contractor or homebuilder would represent a region of the
state and must be registered or licensed with the state. This
legislation also provides that the board shall meet at the call
of the administrator or chairman or at the request of a majority
of the members.
FISCAL NOTE
This legislation would result in minimal cost to the Division of
Building Safety. Current Idaho Code allows members of the Idaho
Building Code Board to receive a stipend of fifty dollars ($50)
per day for each day that the board meets, and members are,
likewise, reimbursed for actual and necessary expenses, subject
to the limits provided in section 67-2008, Idaho Code.
