2 RELATING TO MARTIAL LAW AND ACTIVE DUTY; AMENDING SECTION 46-609, IDAHO CODE,
3 TO AUTHORIZE THE ADJUTANT GENERAL TO ORDER COMMISSIONED OFFICERS AND
4 ENLISTED PERSONNEL TO SPECIAL DUTY, WITH THEIR CONSENT.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 46-609, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 46-609. OFFICERS AND ENLISTED PERSONNEL ON SPECIAL DUTY -- COMPENSATION
9 AND ALLOWANCES. Commissioned officers and enlisted personnel of the national
10 guard may be ordered upon special duty at the direction of the adjutant gen-
11 eral, if with their consent, or at the direction of the governor as commander-
12 in-chief, with or if without their consent, and if ordered to special duty
13 with their consent, notwithstanding the provisions of sections 46-605 and
14 46-607, Idaho Code, such duty may be without any pay or allowances, but if
15 without consent, they shall receive the same pay and allowances as prescribed
16 in section 46-605, Idaho Code, during the time they may continue upon duty
17 under such order.
STATEMENT OF PURPOSE
RS 16235
This proposal amends Idaho Code 46-609 to authorize the
Adjutant General to call Guard members on a voluntary basis to
perform state-related duties. The Governor would continue to be
able to call-up Guard members on an involuntary basis to perform
state duties.

There is no fiscal impact from this proposal.
