  2    RELATING TO THE APPROPRIATION FOR THE PUBLIC  SCHOOLS  DIVISION  OF  TEACHERS;
  3        PROVIDING  FOR  EXPENDITURES  FOR THE PUBLIC SCHOOLS DIVISION OF TEACHERS;
  4        APPROPRIATING GENERAL FUND MONEYS FOR TRANSFER TO THE PUBLIC SCHOOL INCOME
  5        FUND; APPROPRIATING FUNDS TO THE EDUCATIONAL SUPPORT  PROGRAM/DIVISION  OF
  6        TEACHERS  FOR  FISCAL  YEAR  2007;  PROVIDING  MONEYS FOR THE UNEMPLOYMENT
  7        INSURANCE PROGRAM; DIRECTING THAT AN  AMOUNT  BE  DISTRIBUTED  FOR  MASTER
  8        TEACHER  AWARD PAYMENTS; DIRECTING THAT $500,000 BE ALLOCATED FOR TRAINING
  9        TO SERVE THE NEEDS OF GIFTED AND TALENTED STUDENTS; AND  AMENDING  SECTION
 10        33-1004E,  IDAHO  CODE, TO PROVIDE FOR A BASE SALARY INCREASE FOR INSTRUC-
 11        TIONAL STAFF AND TO INCREASE THE MINIMUM  INSTRUCTIONAL  STAFF  SALARY  TO
 12        $30,000.
                                                                        
 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION  1.  The following amount shall be expended for the Public Schools
 15    Division of Teachers for the period July 1, 2006, through June 30, 2007:

 20        SECTION 2.  There is hereby appropriated the following amount to be trans-
 21    ferred to the Public School Income Fund for the period July 1,  2006,  through
 22    June 30, 2007:

 25        SECTION  3.  There  is  hereby  appropriated  to  the  Educational Support
 26    Program/Division of Teachers, pursuant to law and the provisions of this  act,
 27    the  following amount to be expended from the listed funds for the period July
 28    1, 2006, through June 30, 2007:

 33        SECTION 4.  Of the moneys appropriated in  Section  3  of  this  act,  the
 34    amount  necessary  for  the  Unemployment  Insurance Program shall be expended
 35    according to Section 72-1349A, Idaho  Code,  for  the  period  July  1,  2006,
 36    through June 30, 2007.
                                                                        
 37        SECTION  5.  Of  the  moneys  appropriated  in  Section 3 of this act, the
 38    amount necessary shall be awarded to those  instructional  staff  members  who
 39    have been recognized as master teachers by the National Board for Professional
 40    Teaching  Standards,  according  to  the provisions of Section 33-1004E, Idaho

  1    Code.
                                                                        
  2        SECTION 6.  Of the moneys appropriated in Section 3 of this act,  $500,000
  3    shall  be  distributed  to  train  general education teachers, gifted/talented
  4    (G/T) facilitators, administrators and/or parents to better meet the needs  of
  5    gifted/talented students. One-half (1/2) of these funds shall be allocated pro
  6    rata  based on each district's prior year total student enrollment compared to
  7    the prior year total statewide enrollment. One-half (1/2) of these funds shall
  8    be allocated based on the number of gifted/talented  students  identified  and
  9    served  as indicated on the prior year's December 1 child count. The number of
 10    gifted/talented students identified for purposes of  this  section  shall  not
 11    exceed  seven percent (7%) of the district's total student enrollment. No dis-
 12    trict shall receive less than $500. Funds shall be distributed upon submission
 13    and approval of an application submitted to the State Department of  Education
 14    demonstrating how in-service training will establish or improve identification
 15    and service of gifted/talented students in the five (5) mandated talent areas.
 16    The  Superintendent  of  Public Instruction may reallocate any gifted/talented
 17    funds that are left unrequested by school districts to all other  school  dis-
 18    tricts  that  have requested gifted/talented funds, according to the distribu-
 19    tion formula outlined in this section.
                                                                        
 20        SECTION 7.  That Section 33-1004E, Idaho Code, be, and the same is  hereby
 21    amended to read as follows:
                                                                        
 22        33-1004E.  DISTRICT'S  SALARY-BASED  APPORTIONMENT. Each district shall be
 23    entitled to a salary-based apportionment calculated as provided in  this  sec-
 24    tion.
 25        1.  To  determine  the apportionment for instructional staff, first deter-
 26    mine the district average experience and education index by placing all eligi-
 27    ble district certificated instructional employees on the statewide index  pro-
 28    vided  in  section 33-1004A, Idaho Code. The resulting average is the district
 29    index. Districts with an index above the state  average  index  shall  receive
 30    their  actual  index  but  not  more  than  the state average plus .03 for the
 31    1994-95 school year, and shall receive their actual index but  not  more  than
 32    the  state  average plus .06 for the 1995-96 school year, and thereafter shall
 33    receive their actual district index. The district  instructional  staff  index
 34    shall  be  multiplied  by  the instructional base salary of $23,21023,906. The
 35    amount so determined shall be multiplied by the district staff  allowance  for
 36    instructional  staff determined as provided in section 33-1004 2., Idaho Code.
 37    The instructional salary allocation shall be increased by the amount necessary
 38    for each full-time equivalent instructional staff member placed on the experi-
 39    ence and education index to be allocated at least the minimum salary  mandated
 40    by  this  section.  Full-time instructional staff salaries shall be determined
 41    from a salary schedule developed by each district and submitted to  the  state
 42    department of education. No full-time instructional staff member shall be paid
 43    less  than  $27,50030,000. If an instructional staff member has been certified
 44    by the national board for professional teaching standards,  the  staff  member
 45    shall  be  designated as a master teacher and receive $2,000 per year for five
 46    (5) years. The instructional salary shall be increased by $2,000 for each mas-
 47    ter teacher. The resulting amount is the district's salary-based apportionment
 48    for instructional staff. For purposes of this section, teachers qualifying for
 49    the salary increase as master teacher shall be those who have been  recognized
 50    as national board certified teachers as of July 1 of each year.
 51        2.  To  determine  the  apportionment  for  district administrative staff,
 52    first determine the district average experience and education index by placing

  1    all eligible certificated administrative employees on the statewide index pro-
  2    vided in section 33-1004A, Idaho Code. The resulting average is  the  district
  3    index.  Districts  with  an  index above the state average index shall receive
  4    their actual index but not more than the state average plus .03 for the school
  5    year 1994-95, and shall receive their actual index but not more than the state
  6    average index plus .06 for the  1995-96  school  year,  and  thereafter  shall
  7    receive  their  actual district index. The district administrative staff index
  8    shall be multiplied by the base salary of $33,760. The  amount  so  determined
  9    shall  be  multiplied by the district staff allowance for administrative staff
 10    determined as provided in section 33-1004 3., Idaho Code. The resulting amount
 11    is the district's salary-based apportionment for administrative staff.
 12        3.  To determine the apportionment for classified staff, multiply  $18,648
 13    by  the  district classified staff allowance determined as provided in section
 14    33-1004 4., Idaho Code. The amount so determined is the district's  apportion-
 15    ment for classified staff.
 16        4.  The  district's  salary-based  apportionment  shall  be the sum of the
 17    apportionments calculated in subsections 1., 2. and 3., of this section,  plus
 18    the benefit apportionment as provided in section 33-1004F, Idaho Code.

STATEMENT OF PURPOSE

This is the Fiscal Year 2007 appropriation for the Division of Teachers portion of the Public
Schools budget. The pieces of the Public Schools budget that are part of this division’s
appropriation include: 1.) The teachers’ portion of the salary-based apportionment formula;
2.) State paid employee benefits for teachers, which include PERSI and FICA; 3.) Funding
for Master Teacher awards; 4.) Early Retirement Program payouts for teachers; 5.)
Funding for training teachers to work with Gifted & Talented students; and 6.) The
Teachers’ portion of federal pass-through funding to local school districts.

This budget adds funds for an increase of 260 new midterm and full-term support units, an
increase in teacher participation in the Early Retirement Program, and an increase in
available federal pass-through funds. This budget also funds a 3% base salary increase for
teachers, and an increase in the minimum teacher salary, from $27,500 to $30,000. These
changes are made possible by Section 7 of the bill, which amends Section 33-1004E, Idaho
Code.
