1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND URGING THE IDAHO STATE BOARD OF EDUCA-
3 TION TO PROPOSE CHANGES TO THE IDAHO NO CHILD LEFT BEHIND COMPLIANCE
4 AGREEMENT PLAN THAT WOULD PLACE A TEMPORARY SUSPENSION ON THE IMPOSITION
5 OF SANCTIONS FOR NON-TITLE I SCHOOLS UNTIL TWELVE MONTHS AFTER STATE FUND-
6 ING IS MADE AVAILABLE.
7 Be It Resolved by the Legislature of the State of Idaho:
8 WHEREAS, the 2001 Reauthorization of the Elementary and Secondary Educa-
9 tion Act of 1965, commonly referred to as the No Child Left Behind Act (NCLB),
10 raises the accountability of the state and local education agencies to
11 increase the academic achievement of students at all levels of public educa-
12 tion; and
13 WHEREAS, NCLB requires that all students achieve at proficiency or above
14 in reading, mathematics and science within twelve (12) years of enactment; and
15 WHEREAS, schools and district and charter local education agencies and the
16 state are challenged to implement programs and procedures that will help stu-
17 dents who are not reaching proficiency improve academic achievement to the
18 proficient level or above within this time frame; and
19 WHEREAS, under NCLB, federal funding is provided under Title I to schools
20 with student populations composed of more than forty percent of students who
21 participate in the free and reduced lunch program; and
22 WHEREAS, the Idaho State Board of Education places specific sanctions on
23 the schools and district and charter local education agencies that do not meet
24 Adequate Yearly Progress; and
25 WHEREAS, under NCLB, the Title I schools receive an allocation of federal
26 funds each year for supplemental services to remediate and provide the
27 instruction and programs needed in the schools and classrooms to facilitate
28 students who are not meeting the proficiency standards on the Idaho Standards
29 Achievement Test (ISAT). Federal funding for supplemental services in Title I
30 schools includes certified remedial teachers and paraprofessionals who help
31 children meet the proficiency standards in reading, math and, beginning in
32 2007, science; and
33 WHEREAS, under the NCLB Compliance Agreement Plan submitted by the Idaho
34 State Board of Education to the United States Department of Education, the
35 sanctions of NCLB apply to both Title I and non-Title I schools in the state
36 of Idaho; and
37 WHEREAS, under NCLB, no federal funding is provided for remediation at
38 non-Title I schools; and
39 WHEREAS, non-Title I schools educate thousands of children who qualify for
40 the free and reduced lunch program, with many of these schools comprised of
41 twenty percent or more of the student population participating in the free and
42 reduced lunch program; and
43 WHEREAS, parents and teachers in non-Title I schools are making heroic
44 efforts to raise funds for reading and math programs and to provide parent

1 volunteers and additional teaching time to raise these students to proficient
2 levels in reading and math; however, parent volunteers and teachers in non-
3 Title I schools cannot provide adequate resources in comparison to Title I
4 schools; and
5 WHEREAS, the state of Idaho provides no additional remediation funding to
6 non-Title I schools to address the Adequate Yearly Progress deficiencies.
7 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
8 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and
9 the Senate concurring therein, that the Idaho State Board of Education is
10 urged to propose changes to the NCLB Compliance Agreement Plan implementing
11 NCLB in the state of Idaho that would place a temporary suspension on the
12 imposition of sanctions on the non-Title I schools until twelve months after
13 state funding is made available.
STATEMENT OF PURPOSE
RS 16270
Non Title 1 schools are neglecting the average and above average
students in their effort to help the lower students. This bill
would place a temporary suspension on the imposition of sanctions
from No Child Left Behind Legislation on the non-Title I schools
until twelve months after state funding is made available.
