  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE OFFICE OF THE GOVERNOR FOR THE  COMMIS-
  3        SION ON THE ARTS FOR FISCAL YEAR 2006; AND DECLARING AN EMERGENCY.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION  1.  In  addition  to the appropriation made in Section 1, Chapter
  6    169, Laws of 2005, there is hereby appropriated to the Office of the  Governor
  7    for  the  Commission on the Arts the following amount to be expended according
  8    to the designated expense class from the listed fund for the  period  July  1,
  9    2005, through June 30, 2006:

 12    FROM:
 13    Federal Grant Fund                                                     $45,700
                                                                        
 14        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 15    declared to exist, this act shall be in full force and effect on and after its
 16    passage and approval.

Statement of Purpose

This bill re-aligns the Arts Commission’s spending authority to match the distribution of federal grant funds. The agency distributes approximately 90% of its grant funds prior to June 30th and the other 10% in the following fiscal year. Previously, the Arts Commission would request non-cognizable spending authority for the 10% in the next fiscal year; however, the agency request did not meet the requirements of non-cognizable funding. This bill increases the Commission on the Arts on-going spending authority for federal grant funds, and eliminates the need to request annual non-cognizable spending authority increases or supplemental appropriations for grant fund carryover.

Fiscal Note

This bill increases the Arts Commission’s spending authority by $45,700 in the Trustee and Benefits category on an on-going basis, and allows the Commission to distribute 90% of current year grants and 10% of previous year grants each fiscal year.
