import domestic cervidae into Idaho from outside the state; and to provide
that any person in violation shall be guilty of a misdemeanor and any
animal imported in violation shall be seized by officers of the Department
of Fish and Game or other law enforcement officers.

2 RELATING TO DOMESTIC CERVIDAE; AMENDING SECTION 36-711, IDAHO CODE, TO PROVIDE
3 THAT NO PERSON SHALL IMPORT DOMESTIC CERVIDAE INTO IDAHO FROM OUTSIDE THE
4 STATE AND TO PROVIDE THAT ANY PERSON IN VIOLATION SHALL BE GUILTY OF A
5 MISDEMEANOR AND ANY ANIMALS IMPORTED IN VIOLATION SHALL BE SEIZED BY OFFI-
6 CERS OF THE DEPARTMENT OF FISH AND GAME OR OTHER LAW ENFORCEMENT OFFICERS;
7 AND DECLARING AN EMERGENCY.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 36-711, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 36-711. REGULATION OF DOMESTIC FUR-BEARING ANIMALS AND DOMESTIC CERVIDAE.
12 (1) The authority to regulate the breeding, raising, producing, marketing or
13 any other phase of the production or distribution, of domestic fur-bearing
14 animals and domestic cervidae or the products thereof, is vested in the
15 department of agriculture. Nothing in this section shall limit or affect the
16 powers or duties of the fish and game commission and the department of fish
17 and game relating to nondomestic fur-bearing animals and cervidae or the cap-
18 ture and taking thereof. As used in this section, "domestic fur-bearing ani-
19 mal" means fox, mink, chinchilla, karakul, marten, fisher, muskrat, nutria,
20 beaver, and all other fur-bearing animals raised in captivity for breeding or
21 other useful purposes. "Domestic cervidae," as used in this section, means
22 fallow deer (dama dama), elk (cervus elaphus) and reindeer (rangifer
23 tarandus), but shall not include red deer (urasian cervidae) or any subspecies
24 or hybrids thereof. Reindeer (rangifer tarandus) shall not be held for domes-
25 tic purposes north of the Salmon River.
26 (2) Notwithstanding any other provision of law to the contrary, no person
27 shall import domestic cervidae into Idaho from outside the state. Any person
28 violating the provisions of this subsection shall be guilty of a misdemeanor
29 and any animals imported in violation of this subsection shall be seized by
30 officers of the department of fish and game or other law enforcement officers.
31 SECTION 2. An emergency existing therefor, which emergency is hereby
32 declared to exist, this act shall be in full force and effect on and after its
33 passage and approval.
STATEMENT OF PURPOSE
RS 15671
This legislation will amend section 36-711 of Idaho Code to
prohibit the importation of domestic cervidae into Idaho.
FISCAL IMPACT
There is no fiscal impact on the general fund.
