1 AN ACT
2 RELATING TO MOTOR VEHICLE ACCIDENT REPORTS; AMENDING SECTION 49-1306, IDAHO
3 CODE, TO PROVIDE THAT WRITTEN REPORTS OF ACCIDENTS REQUIRED TO BE FOR-
4 WARDED TO THE IDAHO TRANSPORTATION DEPARTMENT BY LAW ENFORCEMENT OFFICERS
5 SHALL NOT CONTAIN PERSONAL INFORMATION ON PERSONS INVOLVED IN THE ACCIDENT
6 BUT SHALL IDENTIFY THE CUSTODIAN OF THE ORIGINAL UNEDITED WRITTEN REPORT.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 49-1306, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 49-1306. WRITTEN REPORTS OF ACCIDENTS. (1) Every law enforcement officer,
11 who in the regular course of duty investigates a motor vehicle accident,
12 either at the time of and at the scene of the accident, or thereafter by
13 interviewing participants or witnesses, shall within twenty-four (24) hours
14 after completing the investigation forward a written report of the accident to
15 the department. The report forwarded to the department shall not contain any
16 personal information, as defined in section 49-117, Idaho Code, on the drivers
17 or occupants of any of the vehicles involved in the accident, but the custo-
18 dian of the original unedited written report shall be identified by title and
19 telephone number.
20 (2) Written reports required to be forwarded by law enforcement officers
21 and the information contained in them shall not be privileged or held confi-
22 dential.
STATEMENT OF PURPOSE

This legislation relates to motor vehicle accident reports;
amending Section 49-1306, Idaho Code, to provide that written
reports of accidents required to forwarded to the Idaho
Transportation Department by Law Enforcement offices shall not
contain personal information on persons involved in the accident,
but shall identify the custodian of the original unedited written
report.

There will be no cost to the General Fund or local government.
