                              BY JUDICIARY AND RULES COMMITTEE
                                                                        
  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF  THE  IDAHO
  3        STATE BOARD OF DENTISTRY.
                                                                        
  4    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  6    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  7    that the Legislature finds that the rules are not consistent with  legislative
  8    intent; and
  9        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
 10    Idaho State Board of Dentistry are not consistent with legislative intent  and
 11    should be rejected.
 12        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 13    sion of the Fifty-eighth Idaho Legislature, the Senate and the House of Repre-
 14    sentatives concurring therein, that IDAPA 19.01.01, rules of the  Idaho  State
 15    Board of Dentistry, adopted as pending rules under Docket Number 19-0101-0502,
 16    the entire rulemaking docket, be, and the same is hereby rejected and declared
 17    null, void and of no force and effect.

Statement of Purpose / Fiscal Impact

                       STATEMENT OF PURPOSE

                             RS 16150

This concurrent resolution would reject a pending rule of the
Board of Dentistry rules of the Idaho State Board of Dentistry. 
The effect of this resolution, if adopted by both houses, would
be to prevent the agency rule from going into effect.

This concurrent resolution has no fiscal impact.
