EDUCATION BOARD - Proposing an amendment to the Constitution of the state
of Idaho to provide for the creation of two separate councils of the State
Board of Education; to provide for a council for higher education providing
general supervision of all state institutions of higher education; to
provide that the government and control of the University of Idaho shall be
by its board of regents; to provide that the government and control of all
other state institutions of higher education be by each institution's board
of trustees; to provide for a council for public schools providing
supervision, government and control of the public schools and any other
state educational institution not connected with postsecondary education;
to provide for the council for higher education and the council for public
schools, convened as a whole, to provide supervision, government and
control of general educational institutions and programs of common access
to both higher education and public school systems; and to provide that the
State Superintendent of Public Instruction shall serve as a member of the
council for public schools.

5 PROVIDE FOR A COUNCIL FOR HIGHER EDUCATION PROVIDING GENERAL SUPERVISION
6 OF ALL STATE INSTITUTIONS OF HIGHER EDUCATION, TO PROVIDE THAT THE GOVERN-
7 MENT AND CONTROL OF THE UNIVERSITY OF IDAHO SHALL BE BY ITS BOARD OF
8 REGENTS, TO PROVIDE FOR THE GOVERNMENT AND CONTROL OF ALL OTHER STATE

14 SCHOOLS, CONVENED AS A WHOLE, TO PROVIDE SUPERVISION, GOVERNMENT AND CON-
15 TROL OF GENERAL EDUCATIONAL INSTITUTIONS AND PROGRAMS OF COMMON ACCESS TO
16 BOTH HIGHER EDUCATION AND PUBLIC SCHOOL SYSTEMS AND TO PROVIDE THAT THE
17 STATE SUPERINTENDENT OF PUBLIC INSTRUCTION SHALL SERVE AS A MEMBER OF THE
18 COUNCIL FOR PUBLIC SCHOOLS; STATING THE QUESTION TO BE SUBMITTED TO THE
19 ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS
20 REQUIRED BY LAW; AND DIRECTING THE SECRETARY OF STATE TO PUBLISH THE
21 AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
22 Be It Resolved by the Legislature of the State of Idaho:
23 SECTION 1. That Section 2, Article IX, of the Constitution of the State
24 of Idaho be amended to read as follows:
25 SECTION 2. BOARD OF EDUCATION. The general supervision of the
26 state educational institutions and public school system of the state
27 of Idaho, shall be vested in a state board of education, the member-
28 ship, powers and duties of which shall be prescribed by law. The
29 board shall comprise two separate councils. The council for higher
30 education shall provide general supervision of all state institutions
31 of higher education. The government and control of the University of
32 Idaho shall be by its board of regents and each of the other individ-
33 ual state institutions of postsecondary education shall be by each
34 institution's board of trustees, the membership of which shall be
35 prescribed by law. The council for public schools shall provide
36 supervision, government and control of the public schools and any
37 other state educational institution not connected with postsecondary
38 education. The council for higher education and the council for pub-
39 lic schools, convened as a whole, shall provide supervision, govern-
40 ment and control of general educational institutions and programs of
41 common access to both higher educational and public school systems.
42 The state superintendent of public instruction shall be ex officio a
43 member of said board the council for public schools.

1 SECTION 2. The question to be submitted to the electors of the State of
2 Idaho at the next general election shall be as follows:
3 "Shall Section 2, Article IX, of the Constitution of the State of Idaho be
4 amended to provide for the creation of two separate councils of the state
5 Board of Education, to provide for a council for higher education providing
6 general supervision of all state institutions of higher education, to provide
7 that the government and control of the University of Idaho shall be by its
8 board of regents, to provide that the government and control of all other
9 state institutions of postsecondary education be by each institution's board
10 of trustees, to provide for a council for public schools providing supervi-
11 sion, government and control of the public schools and any other state educa-
12 tional institution not connected with postsecondary education, to provide for
13 the council for higher education and the council for public schools, convened
14 as a whole, to provide supervision, government and control of general educa-
15 tional institutions and programs of common access to both higher education and
16 public schools, and to provide that the State Superintendent of Public
17 Instruction shall serve as a member of the council for public schools?".
18 SECTION 3. The Legislative Council is directed to prepare the statements
19 required by Section 67-453, Idaho Code, and file the same.
20 SECTION 4. The Secretary of State is hereby directed to publish this pro-
21 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE
RS 15637
The purpose of this Joint Resolution is to amend the Constitution
of the State of Idaho to provide for two separate councils of the
State Board of Education. One would be the Council for Higher
Education and the other would be the Council for Public Schools.
The Resolution also provides that the government and control of
the University of Idaho shall be by its board of regents and each
of the other individual state institutions of higher education
shall be by each institution's board of trustees.
FISCAL NOTE
The Secretary of State's office estimates that it will cost
$50,000 to place this measure on the November ballot.
