removal and remediation actions related to the Bunker Hill Mining and
Metallurgical Complex Superfund Facility shall not constitute public works;

  1                                        AN ACT
  2    RELATING TO THE BUNKER HILL MINING AND METALLURGICAL COMPLEX SUPERFUND  FACIL-
  3        ITY;  AMENDING  CHAPTER  1, TITLE 39, IDAHO CODE, BY THE ADDITION OF A NEW
  4        SECTION  39-130,  IDAHO  CODE,  TO  PROVIDE  THAT  CERTAIN   REMOVAL   AND
  5        REMEDIATION  ACTIONS  RELATED  TO THE FACILITY SHALL NOT CONSTITUTE PUBLIC
  6        WORKS, TO PROVIDE THAT BONDING OF CONTRACTORS MAY BE REQUIRED AND TO  PRO-
  7        VIDE  THAT  THE ADMINISTRATOR OF THE DIVISION OF WASTE AND REMEDIATION AND
  8        THE DIRECTOR OF THE DEPARTMENT OF ENVIRONMENTAL QUALITY SHALL HAVE AUTHOR-
  9        ITY RELATING TO SPECIFIED OPEN COMPETITIVE BIDDING.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION 1.  That Chapter 1, Title 39, Idaho Code,  be,  and  the  same  is
 12    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 13    ignated as Section 39-130, Idaho Code, and to read as follows:
                                                                        
 14        39-130.  REMOVAL -- REMEDIATION -- BUNKER HILL  MINING  AND  METALLURGICAL
 15    COMPLEX  SUPERFUND FACILITY. Notwithstanding any other provision of law to the
 16    contrary, removal and remediation actions in or related to any  operable  unit
 17    of  the  Bunker  Hill mining and metallurgical complex superfund facility per-
 18    formed by or on behalf of the department of environmental  quality  shall  not
 19    constitute  public works pursuant to chapter 57, title 67, Idaho Code, chapter
 20    19, title 54, Idaho Code, or any other provision of Idaho Code. In the letting
 21    and oversight of contracts for such removal or remediation actions, bonding of
 22    contractors may be required. The administrator of the division  of  waste  and
 23    remediation,  department  of  environmental  quality,  and the director of the
 24    department of environmental quality, shall have the authority of the  adminis-
 25    trator  of  the  division of purchasing, department of administration, and the
 26    director of the department of administration, respectively, in requiring  open
 27    competitive  bidding  pursuant  to sections 67-5715 through 67-5718A, 67-5725,
 28    67-5726, 67-5729, 67-5730 and 67-5733, Idaho Code, and any relevant  rules  of
 29    the department of administration.

                    STATEMENT OF PURPOSE

                          RS 16563

To clarify the nature of removal and remediation contracts at 
the Bunker Hill Superfund Site and to designate the Idaho 
Department of Environmental Quality as the authority for letting 
and overseeing these contracts.


                         FISCAL NOTE

There will be no fiscal impact.
