  1                                        AN ACT
  2    RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-624, IDAHO CODE, TO REVISE THE
  3        DUTY OF DRIVERS UPON APPROACHING STATIONARY POLICE VEHICLES OR  AUTHORIZED
  4        EMERGENCY VEHICLES DISPLAYING FLASHING LIGHTS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  49-624, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        49-624.  DRIVER DUTY UPON APPROACHING A STATIONARY POLICE  VEHICLE  OR  AN
  9    AUTHORIZED EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS. The driver of a motor
 10    vehicle,  upon  approaching  a  stationary  police vehicle displaying flashing
 11    lights or an authorized emergency vehicle displaying flashing lights shall:
 12        (1)  If the driver is traveling on a highway with two (2)  or  more  lanes
 13    carrying  traffic  in  the same direction, immediately reduce the speed of his
 14    vehicle below the posted speed limit, proceed with due caution, or and  change
 15    lanes  as  soon  as it is possible to do so in a manner that is reasonable and
 16    prudent under the conditions then existing, with regard to actual  and  poten-
 17    tial hazards.
 18        (2)  If  the  driver  is traveling on a highway with one (1) lane for each
 19    direction of travel, immediately reduce the speed of  his  vehicle  below  the
 20    posted  speed limit, and maintain a safe speed for the road, weather and traf-
 21    fic conditions until completely past the stationary police vehicle  or  autho-
 22    rized emergency vehicle.

                       STATEMENT OF PURPOSE

                             RS 16872

The purpose of this motor vehicle act is to further clarify the
duties and responsibilities of a driver approaching a stationary
police vehicle or authorized emergency vehicle displaying
flashing lights.
The courts have been confused with the current statute, so this
act makes it clear the driver must slow down below the posted
speed limit and change lanes as soon as it is possible to do so
in a manner that is reasonable and prudent under the conditions
then existing, with regards to actual and potential hazards.

This has no fiscal impact on the general fund.
