                                BY APPROPRIATIONS COMMITTEE

  3        CAL YEAR 2008.
  4    Be It Enacted by the Legislature of the State of Idaho:
  5        SECTION  1.  In addition to any other appropriation provided by law, there
  6    is hereby appropriated to the Department of Water Resources for the Water Man-
  7    agement Program the sum of $557,000 from the General Fund, to be expended  for
  8    operating  expenditures for administration of water rights pursuant to Section
  9    42-620, Idaho Code, for the period July 1, 2007, through June 30, 2008.

Statement of Purpose / Fiscal Impact

Statement of Purpose

This is a trailer appropriation to H241. H241 amends the statute relating to the costs of the Department of Water Resources regarding monitoring conditions of the ESPA, updating the ground water model, updating the surface water modeling tool, and updating accounting for water rights administration of Water Rights on the Eastern Snake River Plain. In the 2005 session, the costs were estimated at $1.2 million per year and were to be paid by the water users. H241 changes that so that the Department of Water Resources shall request an annual appropriation not to exceed 50% of the costs. However, for FY 2008 the appropriation is for the full amount of the estimated costs.



Fiscal Note

This appropriation provides $557,000 one-time from the General Fund to the Department of Water Resources for the Water Management Program for operating costs for fiscal year 2008 for the purposes of administering water rights as stated in H241.

This will give the department and the water users a one-year window of opportunity to refine the apportionment of costs between the surface water diversions and the ground water diversions. The fiscal year 2009 costs are estimated at $1 million of which up to $500,000 will be requested from the General Fund and the other part may be paid directly by water users.
