  2    APPROPRIATING ADDITIONAL MONEYS TO THE OFFICE OF THE ATTORNEY GENERAL FOR FIS-
  3        CAL YEAR 2008; INCREASING THE NUMBER OF  AUTHORIZED  FULL-TIME  EQUIVALENT
  4        POSITIONS  FOR  THE  OFFICE  OF THE ATTORNEY GENERAL FOR FISCAL YEAR 2008;
  5        REDUCING THE APPROPRIATION TO THE DEPARTMENT OF  HEALTH  AND  WELFARE  FOR
  6        MEDICAL ASSISTANCE SERVICES FOR FISCAL YEAR 2008; APPROPRIATING ADDITIONAL
  7        MONEYS  TO  THE  OFFICE  OF  THE  ATTORNEY  GENERAL  FOR FISCAL YEAR 2007;
  8        INCREASING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS FOR THE
  9        OFFICE OF THE ATTORNEY GENERAL FOR FISCAL YEAR 2007; REAPPROPRIATING  CER-
 10        TAIN UNEXPENDED AND UNENCUMBERED FUND BALANCES; AND DECLARING AN EMERGENCY
 11        FOR SECTIONS 4, 5 AND 6 OF THIS ACT.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION  1.  In addition to any other appropriation provided by law, there
 14    is hereby appropriated to the Office of the Attorney General for the State and
 15    Legal Services Program the following amounts to be expended according  to  the
 16    designated  expense classes from the listed funds for the period July 1, 2007,
 17    through June 30, 2008:

 26        SECTION 2.  In addition to any other authorization provided  by  law,  the
 27    Office  of the Attorney General is hereby authorized six (6) full-time equiva-
 28    lent positions for the period July 1, 2007, through June 30, 2008.
                                                                        
 29        SECTION 3.  Notwithstanding any other provision of law  to  the  contrary,
 30    the  appropriation of moneys made in Section 1, House Bill No. 322, as enacted
 31    by the First Regular Session of the  Fifty-ninth  Idaho  Legislature,  to  the
 32    Department  of  Health  and  Welfare for Medical Assistance Services is hereby
 33    reduced by  the following amounts from the designated  programs  according  to
 34    the designated expense class from the listed fund for the period July 1, 2007,
 35    through June 30, 2008:

 14    295, Laws of 2006, there is hereby appropriated to the Office of the  Attorney
 15    General  the  following  amounts  to  be  expended according to the designated
 16    expense classes from the listed funds for the period  July  1,  2006,  through
 17    June 30, 2007:

 27    295, Laws of 2006, there is hereby authorized to the Office  of  the  Attorney
 28    General  two  (2)  full-time equivalent positions for the period July 1, 2006,

 30        SECTION 6.  There is hereby reappropriated to the Office of  the  Attorney
 31    General  for  the State and Legal Services Program the unexpended and unencum-
 32    bered balance of moneys as appropriated in Section 4 of this act for the State
 33    and Legal Services Program to be used for the period  July  1,  2007,  through
 34    June 30, 2008.
                                                                        
 35        SECTION  7.  An  emergency  existing  therefor,  which emergency is hereby
 36    declared to exist, Sections 4, 5 and 6 of this act shall be in full force  and
 37    effect on and after passage and approval.

Statement of Purpose / Fiscal Impact


Statement of Purpose

This bill provides funding to implement the provisions of House Bill 166 for an independent Medicaid Fraud Unit in the Office of the Attorney General. This unit will be comprised of two attorneys, two investigators, two auditors, one paralegal, and one legal secretary. This function will receive a 90% federal match for the first three years after certification, and then will receive a 75% match in subsequent years.

Fiscal Note

The fiscal impact to the General Fund for FY 2008 is zero because funding necessary to support this unit is being transferred from the Medicaid appropriation to the Office of the Attorney General. This is the same funding mechanism that the Department of Health and Welfare proposed to fund an expanded unit within the Department of Health & Welfare. Additional funds are provided in a supplemental to the Office of the Attorney General, of which $60,000 is from the General Fund for additional phone capacity, and $50,000 from the Permanent Building Fund to prepare sufficient office space in the Capitol Mall for the expansion of staff. In subsequent years the impact to the General Fund will be approximately $73,000.
