  1                                        AN ACT
  2    RELATING TO STATE LAND; AMENDING CHAPTER 1, TITLE 58, IDAHO CODE, BY THE ADDI-
  3        TION OF A NEW SECTION 58-157, IDAHO CODE, TO PROHIBIT THE LEASE,  EXCHANGE
  4        OR  SALE  OF  STATE LAND TO BE USED TO HOLD DOMESTIC CERVIDAE IN CAPTIVITY
  5        FOR ANY PURPOSE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 1, Title 58, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 58-157, Idaho Code, and to read as follows:
                                                                        
 10        58-157.  LEASE, EXCHANGE OR SALE OF STATE LAND -- DOMESTIC  CERVIDAE  HELD
 11    IN  CAPTIVITY  -- ENCLOSED-PEN HUNTING. Notwithstanding any other provision of
 12    law, subsequent to the effective date of this act, neither the state board  of
 13    land  commissioners, nor any other state agency, shall lease, exchange or sell
 14    to any person, association or corporation, state  land  to  be  used  to  hold
 15    domestic cervidae in captivity for any purpose, including "shooter bull" oper-
 16    ations, which shall mean any enclosed-pen hunting.

                       STATEMENT OF PURPOSE

                             RS 16731

The purpose of this legislation is to prohibit the lease,
exchange, or sale of State Lands for Cervidae ranching.


                           FISCAL NOTE

There will be no fiscal impact to the General Fund.
