  2    RELATING TO FISH AND GAME; AMENDING CHAPTER 5, TITLE 36, IDAHO  CODE,  BY  THE
  3        ADDITION  OF  A  NEW  SECTION  36-506,  IDAHO CODE, TO PROVIDE LEGISLATIVE
  4        INTENT, TO DEFINE TERMS, TO PROVIDE FOR CERTAIN RESTRICTIONS ON THE IMPOR-
  5        TATION AND DISPOSAL OF CERVID CARCASSES OR PARTS OF CERVID CARCASSES  FROM
  6        CHRONIC  WASTING  DISEASE ENDEMIC AREAS, TO PROVIDE EXCEPTIONS, TO PROVIDE
  7        FOR VIOLATIONS AND PENALTIES, TO PROVIDE THAT THE IDAHO DEPARTMENT OF FISH
  8        AND GAME SHALL PUBLISH LISTS OF CHRONIC WASTING DISEASE ENDEMIC AREAS  AND
  9        TO PROVIDE FOR CERTAIN RULEMAKING.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  That  Chapter  5,  Title  36, Idaho Code, be, and the same is
 12    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 13    ignated as Section 36-506, Idaho Code, and to read as follows:
                                                                        
 14        36-506.  RESTRICTION  OF  IMPORTATION OF CERVID CARCASSES FROM CWD ENDEMIC
 15    AREAS. (1) It is the intent of the legislature, with respect to importation of
 16    cervid carcasses from CWD endemic areas, that no part of a cervid spinal  col-
 17    umn or brain shall be imported into the state of Idaho.
 18        (2)  When used in this section:
 19        (a)  "CWD" means chronic wasting disease;
 20        (b)  "CWD  endemic  area"  means  any state within the United States, or a
 21        Canadian province with one (1) or more documented case of  CWD  in  either
 22        wild or domestic cervidae;
 23        (c)  "Head" means the bony part of a skull excluding the skin;
 24        (d)  "Headskin"  means  the  skin  portion  of the head that shall include
 25        lips, eyelids and ears either in part or in total.
 26        (3)  No cervid carcass or parts of a cervid carcass shall be imported into
 27    the state of Idaho from a CWD endemic area,  except  for  the  following  body
 28    parts:
 29        (a)  Boned-out meat and commercially processed cuts of meat;
 30        (b)  Portions of meat with no part of the spinal column or brain attached;
 31        (c)  Hides with the headskin and feet or hooves attached either in part or
 32        in total, or the hide, headskin, feet or hooves unattached;
 33        (d)  Clean  skull  plates,  with  no meat or tissue attached, with antlers
 34        attached;
 35        (e)  Antlers with no meat or tissue attached;
 36        (f)  Finished taxidermy products; and
 37        (g)  Teeth.
 38    Any person violating the provisions of this subsection shall be  found  guilty
 39    as provided in section 36-1401, Idaho Code, and shall be punished as set forth
 40    in section 36-1402, Idaho Code.
 41        (4)  The  provisions  of  this  section  shall  not  apply to nonresidents
 42    traveling through the state of Idaho, provided that  no  person,  including  a
 43    nonresident,  shall dispose of any cervid carcass or parts of a cervid carcass

  1    from a CWD endemic area in the state of Idaho. Any person violating the provi-
  2    sions of this subsection shall be guilty of an infraction and  shall  be  pun-
  3    ished as set forth in section 36-1402, Idaho Code.
  4        (5)  The  Idaho  department  of  fish and game shall publish, on an annual
  5    basis, a list of all CWD endemic areas. During the  interim  between  publica-
  6    tions,  the  department  shall  add  by  temporary rule additional CWD endemic
  7    areas.

This legislation is to provide for certain restrictions on the
importation and disposal of cervid carcasses or parts of cervid
carcasses from chronic wasting disease endemic areas, to provide
exceptions, to provide for violations and penalties, to provide
that the Idaho Department of Fish and Game shall publish lists of
chronic wasting disease endemic areas and to provide for certain
rulemaking.
