  2    RELATING TO TRANSFERS OF FUNDS; PROVIDING A TRANSFER OF FUNDS TO THE FIRE SUP-
  3        PRESSION DEFICIENCY FUND; PROVIDING A TRANSFER OF FUNDS TO THE  PEST  CON-
  4        TROL  DEFICIENCY FUND; PROVIDING A TRANSFER OF FUNDS TO THE HAZARDOUS SUB-
  5        STANCE EMERGENCY RESPONSE FUND; AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  The State Controller shall transfer $9,250,000 from  the  Gen-
  8    eral  Fund  to the Fire Suppression Deficiency Fund. Such moneys shall be used
  9    to reimburse costs incurred by the Forest and Range Fire Protection Program in
 10    the Department of Lands pursuant to Sections 38-131 and 38-131A, Idaho Code.
                                                                        
 11        SECTION 2.  The State Controller shall transfer $47,800 from  the  General
 12    Fund  to  the Pest Control Deficiency Fund. Such moneys shall be used to reim-
 13    burse costs incurred by the Plant Industries  Program  in  the  Department  of
 14    Agriculture pursuant to Section 22-2019, Idaho Code.
                                                                        
 15        SECTION  3.  The  State Controller shall transfer $87,700 from the General
 16    Fund to the Hazardous Substance Emergency Response Fund. Such moneys shall  be
 17    used  to  reimburse  costs  incurred by the Bureau of Homeland Security in the
 18    Military Division of the Office of the Governor pursuant to  Section  39-7110,
 19    Idaho Code.
                                                                        
 20        SECTION  4.  An  emergency  existing  therefor,  which emergency is hereby
 21    declared to exist, this act shall be in full force and effect on and after its
 22    passage and approval.

Statement of Purpose

Idaho Code authorizes the use of deficiency warrants under certain circumstances. The agencies pay the bills and come back to the legislature during the next session for the cash to reimburse those costs. This legislation includes reimbursement for the costs incurred for three purposes. First, it includes funding to reimburse the Department of Lands for the costs of fire suppression during the 2005 season. Second, it reimburses the Department of Agriculture for fiscal year 2005 costs to survey for pests on state and private lands. And third, it includes funding to reimburse the Military Division for costs associated with the cleanup of hazardous materials incidents throughout Idaho.

Fiscal Note

This bill transfers $9,385,500 from the General Fund to three deficiency warrant funds for fiscal year 2006 as follows:

1) The Idaho Department of Lands (IDL) estimates the costs of fire suppression for the 2005 fire season at $11.3 million from the General Fund. However, existing fund balances of $2.1 million can be used leaving the needed transfer of $9,250,000 to the Fire Suppression Deficiency Fund.

2) Last year’s costs were $30,800 for the exotic pest survey program and $17,000 for gypsy moth survey for a total transfer of $47,800 from the General Fund to the Pest Control Deficiency Fund.

3) Costs associated with the cleanup of hazardous materials incidents throughout the state totaled $178,000. Of that amount, $77,000 was paid by the responsible parties involved and $101,000 was paid by the issuance of deficiency warrants; however, an additional $13,300 was later recovered after the issuance of deficiency warrants. As a result, JFAC approved a transfer of $87,700 from the General Fund to the Hazardous Substance Emergency Response Fund.
