]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 417 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO STATE AGENCIES; AMENDING CHAPTER 23, TITLE 67, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 67-2359, IDAHO CODE, TO DEFINE "STATE AGENCIES," 4 TO PROVIDE THAT STATE AGENCIES MAY ENTER INTO CERTAIN AGREEMENTS TO PRO- 5 VIDE ACCESS TO SERVICES AND TO PROVIDE THAT A SERVICE FEE MAY BE CHARGED. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 23, Title 67, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 67-2359, Idaho Code, and to read as follows: 10 67-2359. SERVICE FEES. (1) As used in this section, "state agencies" 11 means all state agencies or departments, boards, commissions or councils. 12 (2) State agencies may enter into agreements with the state's portal man- 13 ager, as designated by the information technology resource management council 14 created in section 67-5745B, Idaho Code, to provide access to services for 15 which a fee is collected. Such agreements may provide for the portal manager 16 to collect the prescribed fee and remit such fee to the state treasurer on 17 behalf of the respective state agency. The portal manager may also charge and 18 collect a reasonable additional fee for portal services.
STATEMENT OF PURPOSE RS 15590 This legislation authorizes State agencies the option of contracting with the State's portal to charge a "convenience fee" for over the counter credit or debit card payments. Credit and debit card transactions have an added cost for the transaction. By contracting with the portal, agencies will eliminate this cost of doing business. This authorization is consistent with the current practice of State agencies accepting electronic payments over the internet. FISCAL NOTE There is no fiscal impact.
