  1                                        AN ACT
  2    RELATING TO IDAHO STATE VETERANS HOMES; AMENDING SECTION 66-901,  IDAHO  CODE,
  3        TO PROVIDE FOR ADMISSION TO AN IDAHO STATE VETERANS HOME TO THE SPOUSES OF
  4        ELIGIBLE VETERANS AND TO DEFINE "SPOUSE."
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section  66-901, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        66-901.  ESTABLISHMENT OF HOMES. On and after July 1, 2000, there shall be
  9    established in the division of veterans services in the  department  of  self-
 10    governing  agencies  in this state homes for veterans which shall hereafter be
 11    known and designated as Idaho state veterans homes., which institutions  Idaho
 12    state  veterans  homes  shall be homes for male and female veterans discharged
 13    under honorable conditions by the government of the United  States;  provided,
 14    that and the spouses of veterans eligible for admission to an Idaho state vet-
 15    erans  home.  A  "spouse"  shall mean the current husband or wife of a veteran
 16    under a marriage recognized by title 32, Idaho Code, and, as allowed by admis-
 17    sions criteria established pursuant to section 66-907, Idaho Code,  the  widow
 18    or  widower  of  a  veteran or the former husband or wife of a veteran under a
 19    marriage recognized by title 32, Idaho Code. Bbefore a person is admitted to a
 20    home, he that person shall be a bona fide resident of this state.

This bill amends Idaho Code  66-901 to allow the admission of
spouses of eligible veterans to the state veterans homes.
                         

                          FISCAL NOTE

There may be an impact on the General Fund arising from a
difference in VA reimbursement.  When a veteran receives
Medicaid, the VA reimburses a portion of the difference between
Medicaid's payment and the actual cost of care.  Additionally the
Division of Veterans Services now has a Medicaid cap.  This
additional reimbursement is not available for a spouse who is
receiving Medicaid.
