]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 490 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO HONEYBEES; AMENDING SECTION 22-2807, IDAHO CODE, TO PROVIDE FOR 3 DUTIES OF THE IDAHO HONEY ADVERTISING COMMISSION AND TO MAKE A TECHNICAL 4 CORRECTION; AMENDING SECTION 22-2808, IDAHO CODE, TO PROVIDE AN EXEMPTION 5 FROM ANNUAL TAXATION FOR HOBBYIST BEEKEEPERS AND TO PROVIDE FOR VOLUNTARY 6 REGISTRATION AND PAYMENT OF FEE; AND AMENDING CHAPTER 28, TITLE 22, IDAHO 7 CODE, BY THE ADDITION OF A NEW SECTION 22-2811, IDAHO CODE, TO PROVIDE FOR 8 THE PUBLICATION OF CERTAIN INFORMATION RELATING TO REGISTERED BEEKEEPERS. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 22-2807, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 22-2807.ADVERTISINGDUTIES. The commission shall plan and conduct a cam- 13 paign for honey and honeyby-productbyproduct advertising, publicity, mer- 14 chandising, sales promotion and research, including bee research, by contract- 15 ing with a service of the hereinabove mentioned, or jointly with any univer- 16 sity or other state or states of the United States and its territories, or 17 individually. 18 SECTION 2. That Section 22-2808, Idaho Code, be, and the same is hereby 19 amended to read as follows: 20 22-2808. LEVY AND COLLECTION OF TAXES -- CHANGE OF TAX BY REFERENDUM -- 21 VIOLATIONS -- PENALTY. (a) There is hereby levied and imposed upon each colony 22 or hive of bees within the state of Idaho on July 1 of each year a continuing 23 annual tax of five cents (5¢) per hive or colony of bees beginning in the year 24 1970 for the purpose of carrying out the provisions of chapter 28, title 22, 25 Idaho Code. Hobbyist beekeepers, as defined in chapter 25, title 22, Idaho 26 Code, are exempt from taxation under this section. Provided however, that any 27 hobbyist beekeeper who desires to support the efforts of the commission, as 28 set forth in section 22-2807, Idaho Code, and desires to be included in regis- 29 tration lists distributed as authorized under section 22-2811, Idaho Code, may 30 register with the commission for that purpose by remitting an annual registra- 31 tion fee of ten dollars ($10.00). 32 (b) The tax may be decreased to not less than three cents (3¢) per hive 33 or colony per year or it may be increased to not more than ten cents (10¢) per 34 hive or colony per year, if approved by a majority of the beekeepers voting in 35 a referendum held for the purpose of determining whether such levy of the tax 36 shall or shall not be changed. If the levy of the tax is changed, the levy of 37 the tax will continue annually at the changed rate until again changed by 38 another referendum. Any resident of Idaho who is a registered Idaho beekeeper 39 with the department of agriculture may vote at such referendum. Any referendum 40 held for the purpose of changing the levy of such tax shall be held at the 41 annual meeting of the Idaho honey industry association or any successor orga- 2 1 nization to this group. 2 (c) Notice of the tax provided for in this section shall be mailed no 3 later than June 1 and the tax shall be due and payable on or before July 1 of 4 each year, and it shall be collected by the Idaho department of agriculture 5 and shall forthwith be paid over by the Idaho department of agriculture to the 6 Idaho honey advertising fund. 7 (d) Said tax shall be a lien upon all apicultural products, equipment, 8 bees and property of the person owning or controlling such bees and shall be 9 prior to all other liens or encumbrances except liens which are declared 10 prior by operation of the statutes of this state. 11 (e) The Idaho honey advertising commission may promulgate the necessary 12 rules and forms to implement and carry out this section. 13 (f) Any person who shall violate the provisions of this section or the 14 rulesand regulationspromulgated under it shall be guilty of a misdemeanor 15 and upon conviction thereof shall be punished by a fine of not more than three 16 hundred dollars ($300) or imprisonment for a period not to exceed ninety (90) 17 days, or both such fine and imprisonment, and all fines collected for viola- 18 tion of this section shall be paid into the Idaho honey advertising fund. 19 SECTION 3. That Chapter 28, Title 22, Idaho Code, be, and the same is 20 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 21 ignated as Section 22-2811, Idaho Code, and to read as follows: 22 22-2811. PUBLICATION OF REGISTERED BEEKEEPERS. The commission shall make 23 available to any pesticide applicator registered with the department, mosquito 24 abatement or pest control district, or university of Idaho county agricultural 25 extension office, a list of beekeepers registered with the commission. The 26 list shall include the names and telephone numbers of the beekeepers, the 27 counties in which they keep bees, and any other information the commission 28 deems necessary to assist in the prevention of accidental poisoning of honey- 29 bees.
STATEMENT OF PURPOSE RS 15718 This legislation will expand the duties of the commission to allow it to support research, and register hobbyist bee keepers on a voluntary basis. The Commission is authorized to publish the names and phone numbers of bee keepers, the counties in which they keep bees and any other information it feels necessary to help prevent the accidental poisoning of honey bees.
