  1                                        AN ACT
  2    RELATING TO ENGINEERS AND SURVEYORS; AMENDING SECTION 54-1223, IDAHO CODE,  TO
  3        INCREASE THE NUMBER OF YEARS COLLEGE OR UNIVERSITY FACULTY CAN TEACH ENGI-
  4        NEERING  DESIGN WITHOUT A LICENSE, TO EXEMPT CERTAIN APPLICANTS FOR LICEN-
  5        SURE FROM EXAMINATION REQUIREMENTS AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 54-1223, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        54-1223.  SAVING  CLAUSE  --  EXEMPTIONS.  A.(1) This chapter shall not be
 10    construed to affect:
 11        (1a)  The practice of any other profession or trade for which a license is
 12        required under any law of this state or the United States.
 13        (2b)  The work of an employee or a subordinate of a person holding a  cer-
 14        tificate  of  registration under this chapter, provided such work does not
 15        include final engineering design or land surveying decisions and  is  done
 16        under  the  direct responsibility, checking, and supervision of, and veri-
 17        fied by, a person holding a certificate of registration under  this  chap-
 18        ter.
 19        (3c)  Any individual teaching upper division engineering subjects that are
 20        classified  as  engineering  design  for any college or university in this
 21        state as of July 1, 1988, and any such individual employed after  July  1,
 22        1988, for a period of three (3) five (5) years from the date of employment
 23        with any college or university in this state.
 24        (4d)  An  individual  doing surveying work for himself, or through a busi-
 25        ness entity, on property owned or leased by  the  individual  or  business
 26        entity,  or  in  which  the individual or business entity has an interest,
 27        estate or possessory right and which affects exclusively the  property  or
 28        interests  of  the  individual or business entity; provided, that all land
 29        surveying maps, plats or plans filed with any county recorder's office  in
 30        the  state of Idaho for the purpose of illustrating or defining boundaries
 31        of property ownership, shall be made and certified by a  registered,  pro-
 32        fessional land surveyor as provided in this chapter.
 33        (5e)  An  individual  doing survey work for himself, or through a business
 34        entity with respect to the location, amendment, or relocation of a  mining
 35        claim.
 36        (6f)  The  practice  of  engineering  by employees of a business entity as
 37        long as the services provided by them are for internal business entity use
 38        only.
 39        B.(2)  The board, at its discretion, may exempt an exceptional  individual
 40    who  has  twelve  (12)  or more years of appropriate experience in engineering
 41    from the requirement for satisfactory completion of an examination in the fun-
 42    damentals of engineering.
 43        C.(3)  An applicant for licensure as a  professional  engineer  either  by

  1    examination  or by comity who has earned a bachelor degree in engineering from
  2    an approved engineering program and  has,  in  addition,  earned  a  doctorate
  3    degree  in  engineering  from a college or university which offers an approved
  4    undergraduate program in the same discipline as the doctorate  degree  earned,
  5    shall  be exempt from the requirement for satisfactory completion of an exami-
  6    nation in the fundamentals of engineering. Honorary doctorate degrees are  not
  7    considered earned degrees for purposes of this subsection.
  8        (4)  In addition to, and notwithstanding other provisions of this chapter,
  9    in  circumstances of emergency creating conditions of imminent and substantial
 10    danger to the public health, safety or environment through  the  provision  of
 11    engineering  services,  the  prosecuting  attorney or the attorney general may
 12    institute a civil action for an immediate injunction to halt the provision  of
 13    engineering services.

                      STATEMENT OF PURPOSE

     This legislation would increase from three to five the
number of years a faculty person could teach upper division
engineering design courses without being licensed.  It would also
allow the Board to waive the requirement for passage of an exam
on the fundamentals of engineering for some persons who have a
doctorate degree.




                          FISCAL NOTE

     There will be no impact to the General Fund of the State or
Dedicated fund of the agency or any other agency or unit of
government.
