]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 551 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC WORKS CONTRACTORS; AMENDING SECTION 54-1904, IDAHO CODE, TO 3 REVISE LICENSING FEES. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 54-1904, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 54-1904. CLASSES OF LICENSES -- RIGHTS GRANTED UNDER LICENSES -- FEES. 8 There shall be six (6) classes of licenses issued under the provisions of this 9 chapter which are hereby designated as Classes AAA, AA, A, B, C and D, the 10 maximum fee for which shall be as hereinafter specified. Each applicant for a 11 license shall specify the class of license applied for in his application. 12 For the purpose of licensing public works contractors under this chapter 13 the board may adopt rules necessary to determine the classification according 14 to their responsibility, and the type and scope of the operations of a 15 licensed contractor to those in which he is classified and qualified to engage 16 as in this chapter provided. 17 Class "AAA" license. Any contractor whose qualifications, ability and 18 responsibility to execute contracts for public works involving an estimated 19 cost of more than three million dollars ($3,000,000) may, upon his application 20 and the payment of a license fee not to exceedonefive hundredfiftydollars 21 ($1500), be granted a Class "AAA" license and be so classified by the board in 22 accordance with the provisions of this chapter. The holder of a Class "AAA" 23 license shall be entitled to engage in the public works contracting business 24 in the state as provided in said license. The renewal fee for a Class "AAA" 25 license shall not exceedonefive hundredfiftydollars ($1500). 26 Class "AA" license. Any contractor whose qualifications, ability and 27 responsibility to execute contracts for public works involving an estimated 28 cost of not more than three million dollars ($3,000,000) may, upon his appli- 29 cation and the payment of a license fee not to exceedonefour hundredfifty30 dollars ($15400), be granted a Class "AA" license and be so classified by the 31 board in accordance with the provisions of this chapter. The holder of a Class 32 "AA" license shall be entitled to engage in the public works contracting busi- 33 ness in the state as provided in said license. The renewal fee for a Class 34 "AA" license shall not exceedonefour hundredfiftydollars ($15400). 35 Class "A" license. Any contractor whose qualifications, ability and 36 responsibility to execute contracts for public works involving an estimated 37 cost of not more than one million dollars ($1,000,000) may, upon his applica- 38 tion and the payment of a license fee not to exceedonethree hundredfifty39 dollars ($15300), be granted a Class "A" license and be so classified by the 40 board in accordance with the provisions of this chapter. The holder of a Class 41 "A" license shall be entitled to engage in the public works contracting busi- 42 ness in the state as provided in said license. The renewal fee for a Class "A" 43 license shall not exceedonethree hundredfiftydollars ($15300). 2 1 Class "B" license. Any contractor whose qualifications, ability and 2 responsibility to execute contracts for public works involving an estimated 3 cost of not more than five hundred thousand dollars ($500,000), may, upon his 4 application and the payment of a license fee not to exceedseventy-fiveone 5 hundred fifty dollars ($75.00150) be granted a Class "B" license and be so 6 classified by the board in accordance with the provisions of this chapter. The 7 holder of a Class "B" license shall be entitled to engage in the public works 8 contracting business in the state as provided in said license. The renewal fee 9 for a Class "B" license shall not exceedseventy-fiveone hundred fifty dol- 10 lars ($75.00150). 11 Class "C" license. Any contractor whose qualifications, ability and 12 responsibility to execute contracts for public works involving an estimated 13 cost of not more than one hundred thousand dollars ($100,000), may, upon his 14 application and the payment of a license fee not to exceedseventy-fiveone 15 hundred dollars ($75.100), be granted a Class "C" license and be so classified 16 by the board in accordance with the provisions of this chapter. The holder of 17 a Class "C" license shall be entitled to engage in the public works contract- 18 ing business in the state as provided in said license. The renewal fee for a 19 Class "C" license shall not exceedseventy-fiveone hundred dollars ($75.100). 20 Class "D" license. Any contractor whose qualifications, ability and 21 responsibility to execute contracts for public works involving an estimated 22 cost of not more than fifty thousand dollars ($50,000), may, upon his applica- 23 tion and the payment of a license fee not to exceedseventy-fivefifty dollars 24 ($750.00), be granted a Class "D" license and be so classified by the board in 25 accordance with the provisions of this chapter. The holder of a Class "D" 26 license shall be entitled to engage in the public works contracting business 27 in the state as provided in said license. The renewal fee for a Class "D" 28 license shall not exceedseventy-fivefifty dollars ($750.00). 29 The board shall be vested with the power to fix annually the amount of the 30 original and renewal license fees for each class of license for the ensuing 31 license year. The amount of the license fee so fixed shall not exceed the max- 32 imum fee set forth in this section. 33 Each license issued by the administrator shall clearly indicate the type 34 and scope of work for which the licensee is qualified and licensed. The holder 35 of the license shall be permitted to submit proposals for and perform only 36 those types of work specified in each license. The administrator may extend 37 the permissible type or scope of work to be done under any license when it is 38 determined by the administrator that the applicant meets all of the require- 39 ments of this chapter to qualify him to do such other work.
STATEMENT OF PURPOSE RS 15365 The proposed changes will allow the Board greater flexibility in dealing with the costs of administration, discipline, enforcement and educational outreach programs. FISCAL NOTE There will be no fiscal impact on the general fund. The division of building safety anticipates that there will be an increase in revenue resulting from assessment of an increased fee for licensure, depending on the amount of the increase over existing fees. The maximum change that could be generated, at existing licensure numbers, would be approximately $307,000.00.
