  2    RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-1002, IDAHO  CODE,  TO  REVISE
  3        THE  CRITERIA  FOR MAXIMUM ALLOWABLE LOAD FOR ANY VEHICLE TIRE OPERATED ON
  4        ANY PUBLIC HIGHWAY, TO PROVIDE NONAPPLICATION TO  NONREDUCIBLE  OVERWEIGHT
  5        AND/OR OVERSIZE VEHICLES AND/OR LOADS AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 49-1002, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        49-1002.  ALLOWABLE LOAD PER INCH WIDTH OF TIRE. (1) The maximum allowable
 10    load for any vehicle tire operated on any public highway shall not exceed  six
 11    hundred  (600)  pounds  per  inch  width  of  tire  and  shall  not exceed the
 12    manufacturer's load rating, whichever is less. Any axle equipped with two  (2)
 13    tires  other  than  the steering axle of a vehicle or a tiller axle on a fire-
 14    fighting apparatus shall be limited to five  hundred  (500)  pounds  per  inch
 15    width  of tire, unless the tire width is fifteen (15) inches or more, then six
 16    hundred (600) pounds per inch width of tire shall be allowed. The width  of  a
 17    tire shall be determined by the manufacturer's description marked on the side-
 18    wall  of  the  tire. Tires on vehicles manufactured prior to July 1, 1987, may
 19    exceed the six hundred (600) pounds per inch width of tire limit subject to  a
 20    maximum  of  eight  hundred  (800)  pounds per inch width of tire This section
 21    shall not apply to nonreducible overweight  and/or  oversize  vehicles  and/or
 22    loads as authorized under section 49-1004, Idaho Code.
 23        (2)  Except  as provided herein, no vehicle or combination of vehicles may
 24    proceed past the place of weighing at temporary or permanent ports of entry or
 25    checking stations when the weight carried on a single tire, as  determined  by
 26    dividing  the  weight  carried  on  an axle or group of axles by the number of
 27    wheels on the axle or group of axles, exceeds on a single axle  the  allowable
 28    weight  above by two thousand (2,000) pounds or more or the weight of a combi-
 29    nation of axles exceeds the allowable weight above by seven  percent  (7%)  or
 30    more. Vehicles or combinations of vehicles which exceed the weight limitations
 31    set  forth  herein  shall  be  required to be brought into compliance with the
 32    applicable weight per inch width of  tire  contained  within  this  subsection
 33    prior  to  continuing  except those vehicles or combinations of vehicles which
 34    are transporting loads which, in the  determination  of  the  board  or  other
 35    proper  authorities  in  charge  of or having jurisdiction over a highway, are
 36    deemed unsafe or impractical to bring into compliance at the place  of  weigh-
 37    ing.  Vehicles  or  combinations of vehicles transporting loads in this latter
 38    category shall obtain a travel authorization to  the  nearest  place  of  safe
 39    unloading, load adjustment or other means of legalization.
 40        (a)  Neither  the  state  of Idaho or its employees, nor any authority and
 41        its employees in charge of or having jurisdiction over a highway, shall be
 42        held liable for personal injury or  property  damage  resulting  from  the
 43        requirements of section 49-1001(8), Idaho Code.

  1        (b)  The  fee for a travel authorization as set forth above shall be fifty
  2        dollars ($50.00) and shall be on a form prescribed by the board  or  other
  3        proper authorities.
  4        (c)  The  board  or other proper authorities in charge of or having juris-
  5        diction over a highway shall adopt and enforce  administrative  rules  and
  6        regulations  as  may be necessary to carry out the provisions of this sec-
  7        tion.

  7        SECTION  1.  That  Section 49-1002, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

 15    fifteen  (15)  inches wide or greater. The width of a tire shall be determined
 16    by the manufacturer's description marked on the sidewall of the tire. Tires on
 17    vehicles manufactured prior to July 1, 1987, may exceed the six hundred  (600)
 18    pounds  per  inch  width  of  tire limit subject to a maximum of eight hundred
 19    (800) pounds per  inch  width  of  tire.  This  section  shall  not  apply  to
 20    nonreducible  overweight  and/or  oversize vehicles and/or loads as authorized
 21    under section 49-1004, Idaho Code.
 22        (2)  Except as provided herein, no vehicle or combination of vehicles  may

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

This legislation will amend section 49-1002, Idaho Code, to
provide that the maximum allowable load on a tire is 600 pounds per
inch of tire width or the manufacturer s rating, whichever is less,
irrespective of the number of tires with which an axle is equipped.

The existing provision for vehicles manufactured prior to July 1,
1987 to exceed six hundred pounds per inch of width subject to a
maximum of eight-hundred pounds is unchanged. Enactment of this
legislation will allow the expanded use of the latest technology of
tires on trucks, truck-tractors and trailers known as "wide base super-
single" tires which would be used in place of a dual tire and wheel
assembly. Use of this tire contributes to more efficient trucking
operations due to its lower weight than duals, which makes possible
more payload per trip and, therefore, a reduced number of trips. Its
lower rolling resistance saves fuel, reduces emissions, lowers cost and
reduces dependence on foreign oil. Safety is enhanced in a variety on
ways, one of which is the elimination of projectile rocks that duals on
occasion can pick up and bring out onto a highway.

The impact of a new wide base super-single tire on pavement and
bridges, relative to tires in current use, is negligible.
