  2    RELATING TO FALSE REPORTS OF EXPLOSIVES; AMENDING SECTION 18-3313, IDAHO CODE,
  3        TO CLARIFY THAT A PERSON WHO MAKES A FALSE  REPORT  OF  EXPLOSIVES  TO  AN
  4        EMPLOYEE  OF  A  POLICE DEPARTMENT, SHERIFF'S OFFICE OR EMERGENCY DISPATCH
  5        CENTER IS GUILTY OF A FELONY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 18-3313, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        18-3313.  FALSE REPORTS OF EXPLOSIVES IN PUBLIC OR PRIVATE PLACES A FELONY
 10    -- PENALTY. Any person who reports to any police officer, sheriff, employee of
 11    a  police department or sheriff's office, employee of a 911 emergency communi-
 12    cations system or emergency  vehicle  dispatch  center,  employee  of  a  fire
 13    department  or  fire  service, prosecuting attorney, newspaper, radio station,
 14    television station, deputy sheriff, deputy prosecuting attorney, member of the
 15    state police, employee of an airline, employee of an airport,  employee  of  a
 16    railroad  or  bus  line,  an  employee  of a telephone company, occupants of a
 17    building, employee of a school district, or a news reporter in the employ of a
 18    newspaper or radio or television station, that a bomb or other  explosive  has
 19    been  placed or secreted in a public or private place knowing that such report
 20    is false, is guilty of a felony, and upon conviction thereof,  shall  be  sen-
 21    tenced to a term of not to exceed five (5) years in the state penitentiary.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

    The purpose of this bill is to add 911 centers and
    civilian employees of police departments or sheriff's
    offices to the list of persons that apply to the crime of
    making a bomb threat.  When the Idaho Code section 18-3313
    was originally passed, the making of a bomb threat was made
    a felony if the threat was made against a number of persons
    or institutions.  For unknown reasons, civilian police
    dispatchers were left off the list.  This bill will rectify
    the problem and clarify that if someone calls in a bomb
    threat to a dispatcher, he or she is guilty of the felony.

    There will be no impact on the general fund of the
