]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 599 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO HORSE BOARD; AMENDING SECTION 25-2505, IDAHO CODE, TO 3 REVISE PROVISIONS RELATING TO ASSESSMENTS ON HORSES, TO PROVIDE THAT IDAHO 4 HORSE BOARD PAID ASSESSMENT CARDS SHALL BE EVIDENCE TO THE STATE BRAND 5 BOARD THAT ASSESSMENTS HAVE BEEN PAID AND TO PROVIDE A PERIOD OF VALIDITY 6 FOR IDAHO HORSE BOARD PAID ASSESSMENT CARDS; AND AMENDING SECTION 25-2510, 7 IDAHO CODE, TO REVISE PROVISIONS AND PROCEDURES REGARDING REFERENDUMS 8 RELATING TO HORSE OWNER MANDATORY ASSESSMENTS. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 25-2505, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 25-2505. ASSESSMENTS -- COLLECTION. (1) There is hereby levied and 13 imposed upon all horses an assessment ofthreeone dollars($31.00) per head 14 to be paid by the owner. The assessment shallrevertincrease toonethree 15 dollars ($13.00) per head ifthea referendum held as provided in section 16 25-2510(1), Idaho Code, results in a majority voteopposingfavoring the three 17 dollar ($3.00) per head assessment.A reversion to a one dollar ($1.00)18assessment shall be effective on the date the director of the department of19agriculture announces, as provided in section 25-2510, Idaho Code, that the20referendum resulted in a majority vote opposing the three dollar ($3.00)21assessment.22 (2) The assessment levied and imposed in this section shall be collected 23 on all brand inspections completed on horses in the state of Idaho. Any person 24 may purchase an Idaho horse board paid assessment card for one hundred dollars 25 ($100) from the Idaho horse board. The paid assessment card shall be evidence 26 to the state brand board, by and through the state brand inspector or a desig- 27 nated agent thereof, at the time a brand inspection fee is collected as pro- 28 vided in section 25-1160, Idaho Code, that the assessment due pursuant to this 29 section has been paid. A paid assessment card shall be valid for a period of 30 one (1) year from the date of purchase. 31 (3) The state brand inspector shall collect the assessment in addition 32 to, at the same time, and in the same manner as the fee charged for state 33 brand inspections. The assessment so collected belongs to and shall be paid to 34 the Idaho horse board, either directly or later by remittance together with a 35 report detailing collection of the assessment. The board shall reimburse the 36 state brand inspector for the reasonable and necessary expenses incurred for 37 such collection, in an amount determined by the board and the inspector. 38 SECTION 2. That Section 25-2510, Idaho Code, be, and the same is hereby 39 amended to read as follows: 40 25-2510. REFERENDUM FOR HORSE OWNERS. (1)Within three (3) years from41July 1, 2000, aA referendumshallmay be held at the discretion of the horse 2 1 board to determine if horse owners favor an increase from one dollar ($1.00) 2 to three dollars ($3.00) in the mandatory assessment prescribed in section 3 25-2505, Idaho Code. The question shall besubmittedmade available to all 4 horse owners who had a brand inspection the year prior to the referendum. 5 Horse owners who have been issued a lifetime brand inspection after July 1, 620002004, are also eligible to participate in the referendum and may do so by 7 requesting a ballot from the Idaho horse board. The Idaho horse board shall 8 publish notice of the referendum once a week for four (4) consecutive weeks, 9 with the last notice being published one (1) week prior to the referendum, in 10 a newspaper of general circulation in each county in the state. The notice 11 shall set forth the process and procedures for voting. Any horse owner eligi- 12 ble to vote in the referendum, and who wishes to vote, shall contact the Idaho 13 horse board for an official ballot as set forth in the notice. Voting on the 14 referendum shall be open for thirty (30) days. Voting shall be by secret bal- 15 lots upon which the words "Do you favorthean increase from one dollar 16 ($1.00) to three dollars ($3.00) in the mandatory assessment to fund the Idaho 17 Horse Board?" are printed with a square before each of the printed words "YES" 18 and "NO" with directions to insert an "X" mark in the square before the propo- 19 sition which the voter favors. If a majority of the referendum vote is in 20 favor of the mandatory assessment of three dollars ($3.00), the provisions of 21 section 25-2505, Idaho Code, shall be extended indefinitely or until such time 22 that the horse board deems it necessary to hold another referendum on the 23 issue. If a majority of the referendum vote is against the three dollar 24 ($3.00) assessment,provided in section 25-2505, Idaho Code,the assessment 25 shallrevert toremain at one dollar ($1.00). If the referendum receives a 26 majority vote in favor of the increase, the assessment shall be increased to 27 three dollars ($3.00) on the date the director of the department of agricul- 28 ture announces the results of the referendum. 29 (2) After five (5) years from the effective date of the referendum 30 required in subsection (1) of this section, and every five (5) years thereaf- 31 ter, a referendum on the continuation of the mandatory assessment to fund the 32 Idaho horse board may be held at the petition of horse owners, or at the 33 request of the Idaho horse board. The question shall be submitted to all horse 34 owners who paid an assessment the year before the referendum and by owners who 35 hold a lifetime brand inspection issued since July 1, 1993. The question shall 36 be submitted by secret ballots upon which the words, "Do you favor the contin- 37 uation of a mandatory assessment to fund the Idaho Horse Board?" are printed 38 with a square before each of the printed words "YES" and "NO" with directions 39 to insert an "X" mark in the square before the question which the voter 40 favors. If a majority of the referendum vote is in favor of continuing the 41 mandatory assessment, all of the provisions of chapter 25, title 25, Idaho 42 Code, shall continue. If a majority of the referendum vote is against continu- 43 ing the mandatory assessment, the assessment imposed in section 25-2505, Idaho 44 Code, shall cease to be mandatory on the date the director of the department 45 of agriculture announces the results of the referendum vote. The procedures 46 necessary to initiate a referendum under this subsection are as follows: 47 (a) A referendum shall be held if the Idaho department of agriculture 48 receives a petition requesting such a referendum signed by ten percent 49 (10%) or more of horse owners who have had a brand inspection, in either 50 of the two (2) immediate past years; or 51 (b) A referendum shall be held if the Idaho department of agriculture 52 receives a written request for such referendum from the Idaho horse board. 53 (3) Any referendum held pursuant to subsections (1) and (2) of this sec- 54 tion shall be conducted as follows: 55 (a) Any referendum must be supervised by the Idaho department of agricul- 3 1 ture. 2 (b) Any referendum shall be held, and the result determined and declared 3 by the director of the department of agriculture, and recorded in the 4 office of the secretary of state. 5 (c) Notice of any referendum must be given by the Idaho horse board ina6 the mannerdetermined by itset forth in subsection (1) of this section. 7 The ballots must be prepared by the Idaho horse board andforwardedbe 8 made available to eligible owners. Returned ballots shall be delivered to 9 the Idaho department of agriculture, main office. 10 (d) The Idaho horse board shall pay the costs of any referendum.
STATEMENT OF PURPOSE RS 15907 The purpose of this proposed legislation is to bring Idaho Code up-to-date regarding the current assessment (one dollar per head) that is paid to the Idaho Horse Board by horse owners who receive a brand inspection. The proposed legislation also establishes an "Idaho Horse Board Paid Assessment Card" that may be purchased by a horse owner for a flat fee of one hundred dollars ($100). This card is good for one year and exempts the horse owner from having to pay an assessment to the Idaho Horse Board at the time of brand inspection regardless of the number of horses inspected during the year. The proposed legislation also revises provisions and procedures regarding holding a referendum to increase the check-off that funds the Idaho Horse Board from one dollar ($1) per head to three dollars ($3) per head.
